HomeMy WebLinkAbout2001100Certificate No 299 Cancel.docBEFORE THE IDAHO PUBLIC UTILITIES COMMISSION in the matter of Certificate of Public Convenience and Necessity No. 299—mcguire estates water system. ) ) ) ) ) CANCELLATION OF CERTIFICATE minute entry The McGuire Estates Water System (McGuire Estates), as reflected in Idaho Public Utilities Commission (Commission) records, is a public utility providing water service to a certificated area known as McGuire Estates in Post Falls, Kootenai County, Idaho. McGuire Estates operates pursuant to Commission Certificate of Public Convenience and Necessity No. 299. Reference Order No. 19218, October 31, 1984. On October 2, 2001, Pauline Lundy, widow of Harold Lundy and the certificated owner/operator of the McGuire Estates Water System, caused to be filed with the Commission evidence of a transfer of ownership of the McGuire Estates Water System from Pauline Lundy to McGuire Estates Water Users Association, Inc., PO Box 2467, Post Falls, Idaho 83877-2467. The ownership transfer documents filed include (1) Agreement for Purchase of Water System dated September 27, 2001; (2) Quitclaim Deed dated September 27, 2001; and (3) Bill of Sale dated September 27, 2001. The Commission acknowledges that with the transfer of ownership from Pauline Lundy to a Water Users Association, the Commission no longer has statutory jurisdiction over the McGuire Estates Water System. Reference Idaho Code § 61-104. The Commission therefore finds it reasonable to cancel Certificate of Public Convenience and Necessity No. 299. DATED at Boise, Idaho this day of October 2001.
