SUBJECT: IN THE MATTER OF HUSKY WATER COMPANY’S APPLICATION
FOR APPROVAL OF ACQUISITION OF THE ASSETS OF RESORT
WATER CO. INC. AND FOR THE ISSUANCE OF A CERTIFICATE OF
PUBLIC CONVENIENCE AND NECESSITY; CASE NO. HWC-W-23-01.
On October 13, 2023, Husky Water Company (“Company”) filed an Application with the
Commission for approval of its acquisition of Resort Water’s assets. Application at 1.
On November 15, 2023, the Commission received a Notice of Withdrawal of Pleadings
from the Company’s attorney requesting that its Application be withdrawn.
Due to the Company’s voluntary withdrawal, Case No. HWC-W-23-01 is now moot and
should be closed within 14 days after the filing of the withdrawal by operation of Rule 68, IDAPA
31.01.01.068.
