HomeMy WebLinkAbout980213.docxFebruary 13, 1998 Charles A.  Ford 8601 N Hayden Pines Way Hayden Lake, ID 83835 RE: Case Nos.  HPN-W-97-1; HPN-W-97-2 Hayden Pines Water System Annual Report—1997 Dear Mr. Ford: The Commission is in receipt of your letter dated February 4, 1998.  Please be advised that your surrender of the Company’s corporate certificate for Hayden Pines Water Co., Inc. does not relieve you from your obligation to file an report with the Commission for calendar year 1997.  Reference Idaho Code 61-401 Information to be Furnished; 61-405 Annual Report.  The annual report information for the 12 months of calendar year 1997 is to be consolidated as if the reported transfer of ownership from Hayden Pines to Allied Water, Inc. had not taken place. Staff will make note and bring to the Commission’s attention that pursuant to Certificate of Public Convenience and Necessity No. 281 you are now operating the Hayden Pines water system in your individual capacity and no longer as a corporation. Please be further advised and you are reminded that the Commission expressly apprised the Company in Order No. 27026 issued June 30, 1997, of the following: We apprise the Company that its Certificate of Public Convenience and Necessity No. 281 remains in effect until the Commission orders otherwise.  Accordingly, the Company is the certificated and acknowledged provider of water service pursuant to Certificate of Public Convenience and Necessity No. 281.  As a certificated public water utility, Hayden Pines has a continuing responsibility pursuant to Idaho Code § 61-302 to maintain and provide adequate service and shall take necessary steps to ensure that such service is provided to its customers pursuant to schedules and tariffs on file with this Commission.  The Company shall assure that access to utility premises is provided to Commission Staff pursuant to the requirements of Idaho Code § 61-521 and shall provide to Staff all records and information requested pursuant to Idaho Code § 61-401, et seq. and the Commission’s Rules of Procedure, IDAPA 31.01.01.221-234. The Commission Staff looks forward to your cooperation and compliance with Commission Orders and applicable statutes and rules.  Staff continues with its investigation, and is reviewing and considering your responses to Staff’s production requests.   Please contact me if you have any questions or if Staff can be of any assistance.
