PACKSADDLE WATER COMPANY–MOTION TO CONTINUE
As you are aware, the owners of the Packsaddle Water Company, Mr. and Mrs. Bainbridge, and the customers of the system are currently attempting to negotiate a conveyance of the system to a homeowner’s association. The case is currently scheduled for hearing on Wednesday, July 19, 1995. The deadline for prefiling testimony and exhibits for the Commission Staff and intervenors is Thursday, July 20, 1995.
On Tuesday, July 11, 1995, the Packsaddle Water Users filed a Petition to Intervene and a Motion to Continue the hearing to allow them an additional 30 days to engage in discovery and to negotiate a settlement. Rule 256(3) provides that motions seeking procedural relief may be acted upon by the Commission without waiting for responses from other parties. Nonetheless, I was informed by Mr. Roy Moulton, attorney for the Bainbridges, that his clients do not object to the Motion to Continue.
