C.)I...IV;,;i\';,v0il;, February 7, 2007 Paul Kjellander, President Idaho Public Utilities Commission PO Box 83720 Boise; ID 83720-0074 RE:GNR-04-01 / Allocation of Uncertified Water Service Territory in the vicinity of Eagle, Idaho Objection to Stipulated Agreement Dear Mr. Kjellander: The City of Boise received notice of the Stipulation between United Water Idaho Inc. and Eagle Water Company, dated January 4 2007. This proposed agreement would resolve the unallocated water service territory by roughly splitting the area. (The area is bounded generally by Hill Road, Horseshoe Bend Road, State Street and Dodgin Avenue). The City of Boise strongly objects to the Stipulated Agreement between United Water Idaho Inc. and Eagle Water Company. As noted in previous correspondence, dated December 7, 2004 (copy attached), the entire area in question is within the Boise City Impact Area and it is anticipated that it will be annexed into Boise City in the near future. The City of Boise has extended municipal sanitary sewer service into this area as indicated on the attached map. Monthly sewer bills are based on the winter water consumption from the water provider once a customer connected to public water. Boise City already has an excellent working relationship with United Water in this regard. Sewer and water providers must work closely to coordinate on many issues. If Eagle Water provides water service to this area, a new franchise agreement will need to be negotiated and additional coordination efforts will be required. Coordination with the Fire Department will be required for construction and maintenance of fire hydrants and to assure service level requirements are met. Boise is also concerned about the history of low pressure problems with the Eagle Water system, and believes that United Water would provide superior service to Boise citizens. In the event that the Idaho Public Utilities Commission approves the Stipulated Agreement, the City requests that Eagle Water Company provide monthly water readings to Boise at no charge for the purpose of preparing sewer bills in the same manner that United Water provides similar information. The City of Boise objects to the Stipulated Agreement and strongly recommends that the entire area within the Boise City Area of Impact be provided water service by United Water Idaho. Dear Mr. Kjellander: It has come to our attention that United Water Idaho (UWI) and Eagle Water Company are discussing which company will serve an area generally bounded by State Street, Horseshoe Bend Road, Hill Road and Dodgin Avenue. This locale is within the City of Boise Impact Area, and it is anticipated that it will be annexed into Boise City at some point in the future. The area is also currently served by Boise City sewer. Thus, the City has a valid interest in the outcome of these discussions. The City of Boise strongly desires that UWI serve this area in lieu of another service provider. It is highly inefficient for the City to deal with multiple water providers in such matters as franchise agreements, water consumption records (for sewer billing purposes), fITe protection issues, water conservation programs construction project coordination and other municipal issues. It is inefficient for the water company as well. Thus, the City recommends that the Public Utilities Commission designate UWI as the sole service provider for this area (map enclosed). It appears that Eagle Water Company has already been designated as the service provider for several small areas within our Impact Area. If possible, the City would like to see this designation changed from Eagle Water Company so that UWI is the primary service provider within the Boise City Area of Impact.
