Re:Application of Round Mountain, LLC for a Certificate of Public Convenience and
Necessity - Case No. GNR- W -03-
Dear Mr. Magnuson:
Mr. Smith, Mr. Fuss, and Ms. Nordstrom who were previously assigned to this matter are no longer with
the Commission. I am a Deputy Attorney General with the Commission and have taken over the legalresponsibilities of this case.
My understanding is that Round Mountain filed an Application for a Certificate of Public Convenience
and Necessity for the operation of a water system with the Commission on August 1 , 2003. On October
, 2003, the Commission received a letter from Charles R. Potts, Jf. on behalf of Round Mountain
requesting all activities be stopped for 90 days. This would allow him to explore the possibility of
turning over the water system to the Elkhorn Ranch Homeowners Association, for their ownership and
operation. This was confirmed in a letter from you dated December 19, 2003 that stated

The system
owner has determined to elect, under Section 2.M of the CC8l;R', to convey the system to a private
non-profit homeowners association in perpetuity. I expect th?(the documentation memori~lizing this
transaction will be complete within the next 45 days." The last update in our files is September 2004
where Staff indicated that you stated the transition to the homeowner s association would be complet~d
by December 31 , 2004.
Could you please send an update to the Commission Secretary regarding the status of the transfer of the
water system to the homeowner s association, and provide the-supporting documentation?
