Re: Live-More Community Club
Dear Mr. Crist:
Your letter about the Live-More Community Club reached me on August 31, 1999. In your letter, you inquired about actions the Live-More Community Club has taken against you.
Our examination of the facts contained in your letter reveals that the Live-More Community Club is incorporated in Idaho. We also contacted Mr. Steven Smith. He said that the Club holds common ownership of several of the subdivision’s assets and facilities including a water system. He indicated that the water bill and the lien against your property in the amount of $1,376.50 represents prior dues and assessments before you installed your own well.
In any event, the Public Utilities Commission only exercises regulatory authority over “for profit” water systems. Since the Live-More Community Club was formed as a non-profit association, the Commission does not have any authority over its sale of water to customers. See Idaho Code § 61-104. Consequently, the Commission is unable to assist you in this matter.
You may want to inquire as to whether Idaho Legal Aid Services or the Idaho Volunteer Lawyers Association might be able to provide you some legal assistance in this matter.
