Dear Commison I am subm a second comment on Kincaid’s (Fox Creek Water and Sewer’s)rate increase announced Yesterday,/3Q/l3 The increase is substantial and I believe NOT based on data regarding oPerating costs.It is clear that oPerating costs of the well have been covered in the last year or So,and i demand that the coission ask for detailed data showing the claimed oPerating cost of the well.I strongly suspect Kincaid as usual,is increasing the rate as retribution for water users bringing up the fact that he plans to Use our well in capacities not in standing with those stated in the water right.y Kincaid has proved vindictive when challenged on any of his action,as is now also the case with his tricking the county into changing his tax rate on Our open space.The City of Victor recently raised it’s rates as seen in the Valley Citizen this month,and clearly Mr.Kincaid is arbitrarily basing his new rates on Victor’s new Publicized rates.New rates must be tied to actual costs. In addition,Please inquire to Mr.Kincaid directly if he plans to use the water commercially in the future and ask him to sign a document stating his intentions on that topic. My recommendation to Fox Creek Water and Sewer is to turn the system over to the residents of the homes,as they alone will have the best interests in mind for water usage and charges.The fact that Kincaid refuses to do SO indicates his desire to I expand the use of the well to commercial and agricultural use - to uses explicitly prohibited -in our current water agreement.
