On February 24,2012,the Commission received correspondence from Evergreen
Water Company (“Evergreen”)seeking permission to cancel its Certificate of Public
Convenience and Necessity (CPCN)and terminate its obligation to provide water service in its
service territory in Benewah County,Idaho.
COMMISSION FINDINGS
The Commission has reviewed Evergreen’s Application and the record in this case,
including documentation provided by Evergreen regarding its transfer agreement with Evergreen
Terrace Water Association (ETWA),a non-profit corporation not subject to the Commission’s
jurisdiction.Accordingly,the Commission approves Evergreen’s Application for cancellation of
its Certificate of Public Convenience and Necessity and the termination of its obligation to
provide water service.
ORDER
IT IS HEREBY ORDERED that the Application of Evergreen Water Company for
cancellation of its Certificate of Public Convenience and Necessity is granted and Evergreen’s
obligation to provide water service is terminated.
THIS IS A FINAL ORDER.Any person interested in the Order may petition for
reconsideration within twenty-one (21)days of the service date of this Order with regard to any
matter decided in this Order.Within seven (7)days after any person has petitioned for
reconsideration,any other person may cross-petition for reconsideration.See Idaho Code §61-
626.
