Dear Mr. DeShazo: It has been brought to the attention of Commission Staff that Eagle Water Company has notified Mary Preuit, Coldwell Banker, Aspen Realty, that Eagle Water will not sell water permits for Bighorn Subdivision until the developer has paid an outstanding bill (allegedly $31,487.80 plus interest) for work done in the subdivision. Upon receipt of the letter, we are informed that the broker for Bighorn immediately stopped marketing the subdivision.  Although you apparently agreed to subsequently rescind your letter, it is our understanding that you have not done so. Staff is very troubled by your actions and your reluctance to comply with the Company’s tariffs and rules pending investigation of this matter by Commission Staff.  Roth & Sons, Inc., as you are aware, alleges that the work performed has nothing to do with the work by or in connection with Eagle Water Company.  It is not apparent from your June 12, 1996, breakdown of costs that the work performed was done for water service related purposes (as part of your regulated company) or was performed as part of your unregulated construction business.  Please provide Staff with further documentation indicating which work (if any) is water service related.  As you are most certainly aware, Staff has long contended that your two businesses must be separated.
