TO AMEND AND REVISE CERTIFICATE OF CONVE- NIENCE AND NECESSITY NO. 278 CERTIFICATE NO. 278 SECOND AMENDED CASE NO. EAG~94- IT IS HEREBY CERTIFIED that the present and future public convenience and necessity requires, or will require, Eagle Water Company, Inc., its successors and assigns to hold construct, or otherwise acquire and to maintain and to operate a water system in and supply water to that certain territory in the vicinity of the city of Eagle, Idaho described as follows: (See Exhibit " and for such purpose to own, hold, construct or otherwise acquire and to maintain and operate within said area reservoirs, tanks, wells and other structures and also to lay, take up, repair replace, renew, extend, maintain and operate water mains, pipe conduits, hydrants and other appliances and equipment in, under, along and across all streets, avenues, alleys, highways, roads and other public places in said area; and to exercise all rights and privileges which may have been granted or which may hereafter be granted to Eagle Water Company, Inc., its successors and assigns by the state of Idaho or by any political subdivision thereof. This Certificate is predicated upon and issued pursuant to Order No. 12621 in Case No. U-I116-OrderNo. 19458 in Case No. U-1116-OrderNo. 21455 in Case No. U-1116- Order No. 24890 in Case No. EAG-93-, Order No. 25232 in Case No. EAG-93-, Order No. 25311 in Case No. EAG-93-3 and Order No. 25577 in Case No. EAG-94-, to which reference is hereby made. Because Eagle Water did not submit legal descriptions of the property added to its service territory in its three prior certificate amendment requests, the Company Certificate was not amended in those cases. Because those legal descriptions have now been filed, they are incorporated in Eagle Water s Certificate amendment request in this case.
