CAP-W-21-01 NOTICE OF APPLICATION NOTICE OF MODIFIED PROCEDURE ORDER NO. 35179 On September 8, 2021, Capitol Water Corporation (“Company”) applied with the Commission for authorization to change its Schedule No. 3, Purchased Power Cost Adjustment (“PPCA”) rate from 2.06% to 0.92%, effective November 15, 2021. The Commission now sets deadlines for interested persons to comment on the Application and for the Company to reply. BACKGROUND The Company’s Schedule No. 3 PPCA rate provides a mechanism for the Company to recover its cost of electricity related to Idaho Power Company’s electric rate schedules that have been approved by the Commission. Application at 1. The Commission approved the Company’s current base rates by Order No. 30762 in Case No. CAP-W-08-02. Id. In that Order, the Commission adopted a three (3) year average of 1,454,401 kilowatt hours of electricity consumption at an average cost of $5.19 to establish rates for the Company. Id. The Company states that, “together these produce a total cost of electric power for the [Company] of $75,483.41.” Id. NOTICE OF APPLICATION YOU ARE HEREBY NOTIFIED that the Company states that its “actual power costs in the calendar year 2020 were $81,505” which is $6,022 more than embedded in the Company's base rates. Id. The Company asserts this additional cost requires an adjustment to customer rates of 0.92%. Id. YOU ARE FURTHER NOTIFIED that the Company proposes to recover these additional electric power costs by replacing the Company's currently approved Schedule No.3 Purchased Power Cost Adjustment rate of 2.06% with a new Schedule No. 3, PPCA rate of 0.92%. Id. NOTICE OF APPLICATION NOTICE OF MODIFIED PROCEDURE ORDER NO. 35179 2 YOU ARE FURTHER NOTIFIED that attached to the Application is a copy of the Company's currently approved Schedule No. 3 along with a copy of a new Schedule No. 3 reflecting the proposed PPCA rate. Id. at 2. YOU ARE FURTHER NOTIFIED that the Company included a worksheet with the Application detailing its electric power cost calculations, a copy of the proposed Schedule No. 3 with the proposed PPCA, and a copy of a direct customer notice and a news release that will be sent to the Idaho Statesman and Idaho Business Review. Id. at 2. YOU ARE FURTHER NOTIFIED that the Company requests the Commission process this Application under its rules of modified procedure and approve the proposed PPCA rates effective November 15, 2021. YOU ARE FURTHER NOTIFIED that the Application is available for public inspection during regular business hours at the Commission’s office. These documents are also available on the Commission’s web site at www.puc.idaho.gov. Click on the “WATER” icon, select “Open Cases,” and click on the case number as shown on the front of this document. YOU ARE FURTHER NOTIFIED that all proceedings in this case will be held pursuant to the Commission’s jurisdiction under Title 61 of the Idaho Code. YOU ARE FURTHER NOTIFIED that all proceedings in this matter will be conducted pursuant to the Commission’s Rules of Procedure, IDAPA 31.01.01.000 et seq. NOTICE OF MODIFIED PROCEDURE YOU ARE FURTHER NOTIFIED that the Commission has determined that the public interest may not require a formal hearing in this matter, and that it will proceed under Modified Procedure pursuant to Rules 201 through 204 of the Commission’s Rules of Procedure, IDAPA 31.01.01.201 through .204. The Commission notes that Modified Procedure and written comments have proven to be an effective means for obtaining public input and participation. YOU ARE FURTHER NOTIFIED that a person desiring to state a position on this Application may file a written comment explaining why the person supports or opposes the Application. Persons who would like a hearing must specifically request a hearing in their written comments. Person shall have until October 21, 2021, to file written comments. Comments must be filed through the Commission’s website or by e-mail unless computer access is unavailable. To comment electronically, please access the Commission’s home page at www.puc.idaho.gov. YOU ARE FURTHER NOTIFIED that if no written comments or protests are received within the time limit set, the Commission will consider this matter on its merits and enter its Order without a formal hearing. If written comments are received within the time limit set, the Commission will consider them and, in its discretion, may set the same for formal hearing. O R D E R IT IS HEREBY ORDERED that the Company’s Application be processed by Modified Procedure, Rule 201-204 (IDAPA 31.01.01.201-.204). Interested persons must file written comments by October 21, 2021. The Company must file any reply comments by November 4, 2021. IT IS FURTHER ORDERED that parties should continue to comply with Order No. 35058, issued June 3, 2021. All pleadings should be filed with the Commission electronically and shall be deemed timely filed when received by the Commission Secretary. See Rule 14.02. Service between parties should also be accomplished electronically. Voluminous discovery-related documents may be filed and served on CD-ROM or a USB flash drive.
