U-llOl- CERTIFICATE NO. 260 IT IS HEREBY CERTIFIED that the present and future public convenience and necessity requires and will require the Brian Water Corporation , its successors and assigns to own , hold , construct or otherwise acquire and to maintain and operate water system in and supply water to the residents of the Brian Park Subdivision and terri- tory contiguous thereto located in Lot 1 , Sec. 33 T3N, R3E , BM , in Ada County, Idaho for such purpose to hold , construct or otherwise acquire and to maintain and operate within said area, reservoirs, tanks , wells and other structures and also to lay, take up, repair , replace , renew extend , maintain and operate water mains, pipes , conduit , hydrants, and other appliances and equipment in , under , along and across all streets , avenues , alleys , highways , roads and other public places in said area.To exercise all rights and privileges which have been - granted unto said Brian Water Corporation or which may hereafter be granted unto said Brian Water Corporation its successors and assigns by any franchise or permit conferred or hereafter conferred upon said Brian Water Corporation , its successors and assigns by Ada County, Idaho or by any municipality created out of said and or contiguous territory, or any part thereof , or by the State of Idaho or by any political subdivision thereof. This certificate is predicated upon and issued pursuant to the Findings and Order of this Commission , the same being Order No. 7884 in the above entitled matter made and entered this 30th day of August 1965. The Appli~aot is a corporation organized and existing under and by vi,:r:tue of the laws of the State of Idaho and is duly authorized and qualifi~d to do bu~iness in the State Qf Idaho, its Articles of Incorpo'.t'ation was filed with its application. The well, pressure tank and distribution system was originally installed by Harris Brothers Lumber Company, which company transferred all rights and interest in and to said water system to Albert Blaser who ha!S in turn conveyed all rights and interest in said water system to the applicant ~ Brian Water Corpora tion .The Brian Water Corporation has not been charging its customers for the water used ~ but will upon the issuance of this Certificate start charging its customers for water service. The entire water system consiSJts of lOne 8" well, 68 feet deep~ with the static water level approximately 17 feet below the surface of the ground and is located on Lot 13, Block 2 of Brian Park Subdivision Th~r.e is i.ncluded in this system a l, 925 gallon undergrow,d pressure tank feeding into a distribution system con- sisting of 6" ~ 4", and 2" asbestos = cement water mains.This system has been engi,neered by a competent engineering firm and plans a,nd tests have be~n submitted for approval to other state and county agencies. The application and supporting data shows that there are now ten customers receiving service from the system and there are thirty-one additional connections that may receive service some time in the future. The Applicant proposes to install meters to measure the quanity of water used by each customer for billing purposes and has submitted a meter rate for approval in its application.Applicant also propose$ to charge $75.00 for each new connection to cover the cost of the m~tlfJr and the meter installation. Applicant has submitted the estimated original cost of the plant in service at the time that Brian Water Co:t'poration acquired the system ~ as well as other financial data required in this applica- tion.The accounting for this acquisition by Applicant is prescribed by the Uniform System of Accounts adopted by this commission and will apply in this case. There are no water utilities who can economically and feasibly serve the residents of the Brian Park Subdivision. -------- THAT the Applicant, Brian Water Corpora tien, is a cor- poration organized and existing under and by virtue of the laws of the State af Idaho and is engaged as a public utility in fur- nishing water service in the State of Idaho and is under the jurisdiction of this Commission. THAT this water system has been installed complete with well, pressure tank and distribution mains under competent engineering supervision. III THAT the meter rates requested in the application are not unreasonable and should be approved. THAT no other water utility is close enough to economically serve the residents of the Brian Subdivision. Tr~T the Applicant has the financial ability to maintain a water utility in the area in which distribution lines are now built. THAT the Applicant should be issued Certificate of Convenience and Necessity Number 260 to include Brian Park Subdivision and territory contiguous thereto located in Lot 1 , Section 33 T3N , R3E , BM in Ada County, Idaho. ----- IT IS THEREFORE ORDERED that Certificate of Convenience and Necessity Number 260 be issued to Brian Water Corporation to serve domestic and lawn sprinkling water to the residents of the Brian Park Subdivision and territory contiguous thereto located in Lot 1 , Section 33 T3N , R3E , BM in Ada County, Idaho. AND IT IS FURTHER ORDERED that the rates requested in the application be and the same are hereby approved.And that Brian Water Corporation submit tariff schedules , showing rates and charges , to this Commission for approval.
