BCS-W-01-1 SECOND AMENDED CERTIFICATE NO. 296 IT IS HEREBY CERTIFIED that the present and future public convenience and necessity requires, and will require, Bar Circle “S” Ranch, Inc., an Idaho corporation, its successors and assigns, to hold, construct or otherwise acquire, and to maintain and operate a water system in and supply water to that certain territory known as Bar Circle “S” Ranch Subdivision in Kootenai County, Idaho as described as: WELL SITE: A part of Lot 1, Block A, Bar Circle S Ranch as filed for record in the office of the Kootenai County Recorder, Kootenai County, Idaho, more particularly described as Beginning at the Southeast Corner of said Lot 1; thence South 89°14'15" West along the South Line of said Lot 1, 200 feet; thence North 0°39'51" West, 200 feet; thence North 89°14'15" East, 200 feet to a point on the East Line of said Lot 1; thence South 0°39'51" East along said East Line, 200 feet to the Place of Beginning. RESERVOIR SITE: A part of the Southeast Quarter of the Northeast Quarter of Section 26, Township 52 North, Range 4 West, Boise Meridian, Kootenai County, Idaho, more particularly described as follows: The South 60 feet of said Southeast Quarter of the Northeast Quarter of Section 26, AND a parcel described as Beginning at the Southeast Corner of the Northeast Quarter of said Section 26; thence South 89°25'05" West along the South Line of said Northeast Quarter, 625 feet; thence North, 60 feet to the True Point of Beginning for this Description; thence North, 50 feet; thence South 89°25'05" West, 100 feet; thence South, 50 feet, thence North 89°29'05" East, 100 feet to the True Point of Beginning for this Description. SERVICE AREA: The NW¼ Section 23, and the S½ of Section 23, also the N½ of Section 26 and the N½ of the NW¼ and SW¼ of Section 26, all in T52 N, R4W B.M. Kootenai County, Idaho. And those additional service areas approved in Order No. 28895, and described as: All that portion of Section 24, Township 52 North, Range 4 West, Boise Meridian, Kootenai County, Idaho, lying West of Highway 95 and South of the following described line: Beginning at a point 600 feet North of the West Quarter Corner of said Section 24; thence, South 83°55'38" East 3,059.36 feet; thence, South 81°03'59" East 590.0 feet to the terminus point of said line. Also all that portion of the South half of Section 24, Township 52 North, Range 4 West, Boise Meridian, Kootenai County, Idaho, lying East of Highway 95, EXCEPTING THEREFROM the East half of the East half of said South half. Also the North half of Section 25, Township 52 North, Range 4 West, Boise Meridian, Kootenai County, Idaho, EXCEPTING THEREFROM the East half of the East half of said North half. Also all that portion of the South half of Section 25, Township 52 North, Range 4 West, Boise Meridian, Kootenai County, Idaho, lying West of the precipitous edge of what is commonly referred to as the Rimrock.. Also all that portion of the Northeast Quarter of Section 35, Township 52 North, Range 4 West, Boise Meridian, Kootenai County, Idaho, lying East of Government Way, as presently located. and for such purpose to own hold, construct or otherwise acquire and to maintain and operate within said territory water wells, reservoirs, tanks, towers, standpipes, collectors, settling basins, galleries and other works and structures, and also to lay, take up, repair, replace, renew, extend, alter, maintain and operate water mains, pipes, conduits, hydrants, and other appliances, equipment and facilities in, upon, over, under, along, through, and across all streets, avenues, alleys, highways, roads and other public places in said territory as the same now exists, laid out or established and to exercise all rights and privileges that have been, or may hereafter be, granted Bar Circle “S” Ranch, Inc., its successors or assigns, by any city or village, or by any county, or by the State of Idaho, or by any municipality created out of such said territory and areas, or any part thereof, or by the State of Idaho, or by any political subdivision thereof in the area hereinbefore set forth. This Certificate is predicated upon and issued pursuant to the findings and provisions of Order No. 28895 issued the day of November 2001. DATED at Boise, Idaho, this day of November 2001.
