(“Acme”or “Company”)filed an Application for a Certificate of Public Convenience and Necessity authorizing the Company to operate as a water utility in the State of Idaho. YOU ARE FURTHER NOTIFIED that Acme has also requested authority to institute a new hookup fee in order to finance new construction. YOU ARE FURTHER NOTIFIED that Acme included a copy of the Company’s registration as a corporation with the Idaho Secretary of State. YOU ARE FURTHER NOTIFIED that Acme’s water system consists of two wells,a 200,000-gallon storage reservoir,distribution mains and fire hydrants. YOU ARE FURTHER NOTIFIED that Acme provides water service to a small 260 equivalent residential units (ERU)on 107 lots located in the area of Schweitzer Mountain Ski Resort,in Township 58N,Range 2W,Section 29,Bonner County,Idaho.Acme has 20 residential customers and 6 unserviced,standby accounts. YOU ARE FURTHER NOTIFIED that Acme submitted a plat of Schweitzer Village, the Company’s requested service area in Bonner County,Idaho. YOU ARE FURTHER NOTIFIED that Acme states that there is no other existing water system located near the requested service area with the capacity to economically serve the area. YOU ARE FURTHER NOTIFIED that the following documents were included in the Company’s Application as attachments:a site plan developed by James A.Sewell and Associates L.I.C.,Consulting Engineers;Sanitary Survey conducted by the Panhandle Health District in November 2011;Application for Water Permit;estimated cost for utility construction and NOTICE OF APPLICATION NOTICE OF MODIFIED PROCEDURE ORDERNO.33011 1 statement of anticipated annual maintenance costs;Income Tax Statements (2010-2011), Company Articles of Incorporation and Bylaws;Company rules and regulations;main extension rules;tariff rate schedules;sample invoice;and notices. NOTICE OF MODIFIED PROCEDURE YOU ARE FURTHER NOTIFIED that the Commission has determined that the public interest may not require a formal hearing in this matter and will proceed under Modified Procedure pursuant to Rules 201 through 204 of the Idaho Public Utilities Commission’s Rules of Procedure,IDAPA 31.01.01.201 through .204.The Commission notes that Modified Procedure and written comments have proven to be an effective means for obtaining public input and participation. YOU ARE FURTHER NOTIFIED that any person desiring to state a position on this Application may file a written comment in support or opposition with the Commission within forty-two (42)days from the service date of this Notice.The comment must contain a statement of reasons supporting the comment.Persons desiring a hearing must specifically request a hearing in their written comments.Written comments concerning this Application shall be mailed to the Commission and the Applicant at the addresses reflected below: Commission Secretary Acme Water Works,Inc. YOU ARE FURTHER NOTIFIED that all proceedings in this case will be held pursuant to the Commission’s jurisdiction under Title 62 of the Idaho Code,specifically Idaho Code §62-604 and 62-615.The Commission may enter any final Order consistent with its authority under Title 62 and Commission Rule of Procedure 114,IDAPA 3 1.01.01.114. YOU ARE FURTHER NOTIFIED that all proceedings in this matter will be conducted pursuant to the Commission’s Rules of Procedure,IDAPA 31.01.01.000 et seq. ORDER IT IS HEREBY ORDERED that this Application will be processed under Modified Procedure.Persons interested in submitting written comments regarding this case or protesting the use of Modified Procedure should do so no later than 42 days from the service date of this Order.
