AWS-W-23-01 NOTICE OF SUSPENSION OF PROPOSED EFFECTIVE DATE ORDER NO. 35766 On March 7, 2023, Algoma Water System dba Algoma Water (“Company” or “Algoma”) applied to change rates for its residential and commercial customers.1 Application at 1. The Company proposes to increase rates for residential customers to $54.00 per month and increase rates for commercial customers to $89.00 per month. Id. The Company’s Application includes its rate calculation and several exhibits. The Company did not request an effective date in its Application. In a filing made on April 7, 2023, the Company requested a June 1, 2023, effective date. This request was not considered by the Commission at its April 10, 2023, Decision Meeting. At the Commission’s April 25, 2023, Decision Meeting, the Commission considered Staff’s recommendation to suspend the Company’s effective date for 30 days and five months, consistent with Idaho Code § 61-622(4). With this Order the Commission issues a Notice of Suspension of the Proposed Effective Date. NOTICE OF SUSPENSION OF PROPOSED EFFECTIVE DATE The Company filed its Application on March 7, 2023. On April 7, 2023, the Company proposed a June 1, 2023, effective date. The Commission finds that Algoma’s proposed effective date does not provide adequate time for Commission Staff and interested persons to evaluate the Company’s proposal. Pursuant to Idaho Code § 61-622, the Commission suspends the proposed changes for thirty (30) days and five (5) months or until the Commission enters an order accepting, rejecting, or modifying the proposed rate increases. 1 The Company’s Application was not entered into the Commission’s case management system until April 6, 2023. NOTICE OF SUSPENSION OF PROPOSED EFFECTIVE DATE ORDER NO. 35766 2 ORDER IT IS HEREBY ORDERED that the June 1, 2023, effective date that Algoma proposes for its rate increases is suspended for thirty (30) days plus five (5) months or until the Commission enters an earlier order accepting, rejecting, or modifying the proposed rate increases. IT IS FURTHER ORDERED that parties comply with Order No. 35375, issued April 21, 2022. Generally, all pleadings should be filed with the Commission electronically and will be deemed timely filed when received by the Commission Secretary. See Rule 14.02. Service between parties should continue to be accomplished electronically when possible. However, voluminous discovery-related documents may be filed and served on CD-ROM or a USB flash drive.
