ATW-W-23-01 ORDER NO. 36018 On January 31, 2023, Atomic Water Company, LLC, (“Company”) applied to the Idaho Public Utilities Commission (“Commission”) for a Certificate of Public Convenience and Necessity (“CPCN”), to provide water service in the unincorporated town of Atomic City in Bingham County, Idaho. On October 31, 2023, the Commission issued Order No. 35973, granting the Company’s request for a CPCN and establishing rates to collect an annual revenue requirement of $17,096. In addition to granting a CPCN and setting rates, the Commission also directed the Company to submit conforming tariffs in compliance with Commission approved rates and charges no later than 30 days following the service of Order No. 35973. On November 16, 2023, the Company submitted a Compliance Filing with revised tariffs reflecting the rates approved in Order No. 35973. Commission Staff reviewed the filing and, at the Commission’s November 21, 2023, decision meeting, recommended that the Commission accept the filing with an effective date of October 31, 2023. COMMISSION FINDINGS AND DECISION The Commission has jurisdiction over the Company’s Application and the issues in this case under Title 61 of the Idaho Code including Idaho Code §§ 61-301 through 303. The Commission is empowered to investigate rates, charges, rules, regulations, practices, and contracts of all public utilities and to determine whether they are just, reasonable, preferential, discriminatory, or in violation of any provisions of law, and to fix the same by order. Idaho Code §§ 61-501 through 503. Having reviewed the record and the Company’s submission, the Commission finds that the Company has complied with Order No. 35973. ORDER IT IS HEREBY ORDERED that the Company’s Compliance Filing is accepted, effective October 31, 2023. ORDER NO. 36018 2 THIS IS A FINAL ORDER. Any person interested in this Order may petition for reconsideration within twenty-one (21) days of the service date upon this Order regarding any matter decided in this Order. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. Idaho Code §§ 61-626.
