) JOINDER IN SETTLEMENT
COMES NOW, Community Action Partnership Association of Idaho (hereinafter
"CAPAI") and, pursuant to prior Commission Notices and Orders, hereby notifies the
Commission and all parties to this proceeding that it joins in the terms of the Settlement
Stipulation executed by the other parties to this proceeding, and Motion for Approval thereof,
filed with the Commission in this matter on February 7, 2013.
CAPAI did not initially join in the settlement agreement reached by the parties in January
because it had areas of interest and concern that required additional time to investigate before
CAPAI could determine whether the proposed settlement was in the best interests of its
constituents and, if not, whether to file testimony advocating for terms and conditions not
contained in the Settlement Stipulation. CAPAI has been involved in numerous discussions,
engaged in informal discovery, and otherwise worked with AVISTA personnel and members of
CAPAI'S NOTICE OF JOINDER IN SETTLEMENT 1
the Commission Staff to investigate issues and possible changes to, among other things,
AVISTA'S rate design for its residential customers. Both AVISTA and Staff cooperated with
and facilitated CAPAI's efforts in this regard and CAPAI is now of the opinion that, although
there remains additional work to be done in analyzing certain aspects of AVISTA'S residential
rate design, among other matters, that the Settlement Stipulation, as proposed and executed by
the other parties, is in the best interests of AVISTA's low-income ratepayers and all ratepayers in
general. CAPAI's support of the settlement as proposed is unconditional.
Thus, although at this point it is not feasible for CAPAI to formally sign the Settlement
Stipulation already filed with the Commission, this Notice is intended to serve as a defacto
execution of and joinder in the settlement.
