UPR-R-99-2 NOTICE OF HEARING YOU ARE HEREBY NOTIFIED that the Union Pacific Railroad Company (Union Pacific) has indicated that it intends to seek authority from the Surface Transportation Board (STB) to abandon its “Boise cut off” from Milepost 423.6 to Milepost 443.0, a distance of 19.4 miles near Boise, Ada County, in the state of Idaho. Pursuant to Idaho Code § 62-424, the Commission will conduct a public hearing to determine whether the abandonment (1) would adversely affect the area being served, (2) would impair the access of Idaho communities to vital goods and services and market access to those communities, and (3) whether the line has potential for profitability. If the Commission finds in the affirmative on the three foregoing criteria, then it will transmit a report of its findings to the Interstate Commerce Commission on behalf of the people of the state of Idaho. YOU ARE FURTHER NOTIFIED that the Commission will conduct a formal hearing in this case for the purpose of receiving input from all interested parties including the general public regarding the affect that the abandonment would have based on the criteria set forth above. The hearing will be conducted commencing at 9:30 A.M. ON FRIDAY, JUNE 18, 1999, AT THE OFFICES OF THE IDAHO PUBLIC UTILITIES COMMISSION, 472 WEST WASHINGTON STREET, BOISE, IDAHO. YOU ARE FURTHER NOTIFIED that all hearings and prehearing conferences in this matter will be held in facilities meeting the accessibility requirements of the Americans with Disabilities Act. In order to participate, understand testimony and argument at a public hearing, persons needing the help of a sign language interpreter or other assistance may ask the Commission to provide a sign language interpreter or other assistance as required under the Americans with Disabilities Act.
