THE COMMISSION'S 2009 ASSESSMENT FEE CASE NO. INP-09-
ORDER NO. 30847
On May 22 2009, Idaho Northern & Pacific Railroad (INPR) filed an objection to an
interest component on its 2008 IPUC regulatory assessment fee. INPR did not pay its regulatory
fee in 2008, and interest accrued at the statutory rate until the fee was paid. See Idaho Code
61-1005. In its objection, INPR states that it did not receive the itemized "statement of 2008
annual regulatory fee" that was mailed to the Company in 2008. Accordingly, INPR states that
only upon receipt of the current 2009 annual assessment information did we realize a fee for the
prior year was in fact outstanding.The Railroad subsequently paid the 2008 and 2009
regulatory fees, but asks the Commission to waive the interest that accrued on the 2008
assessment while it was unpaid.
On June 16 2009, the Commission convened a hearing to consider INPR's objection
as required by Idaho Code ~ 61-1007. Based on the evidence received at the hearing, the
Commission finds that it is appropriate to waive the accrued interest in the amount of $479.84 on
the INPR 2008 regulatory fee.
ORDER
IT IS HEREBY ORDERED that the interest that accrued on the Idaho Northern &
Pacific Railroad 2008 IPUC regulatory fee in the amount $479.84 is waived.
THIS IS A FINAL ORDER. Any person interested in this Order may petition for
reconsideration within twenty-one (21) days of the service date of this Order. Within seven (7)
days after any person has petitioned for reconsideration, any other person may cross-petition for
reconsideration. See Idaho Code ~ 61-626.
