HomeMy WebLinkAbout980202.docx February 2, 1998 Craig Arthur 303 Griffin Street Post Falls, ID 83854 RE:Silver Valley Rail Line  Records Dear Mr. Arthur: Enclosed for your information are three documents containing information about the Silver Valley Rail Line.  The first document (4 pages) is a rail line “profile.”  This document generally shows the characteristics of the Wallaced Branch rail line beginning in Plummer and ending near Mullan, Idaho.  The numbers at the top of the pages are milepost markers. The second document is Union Pacific’s Application to abandon the line.  You will note on page  9 that the Railroad discusses estimated traffic figures.  The third document is the state’s and the three mining company’s post-hearing brief in the case.  You will note that on pages 10-19, we discuss rail traffic estimates. The Interstate Commerce Commission’s decision can be found at Vol. 9 I.C.C. 2d 325 (1992) which can be reviewed at any government repository library, e.g. the Law Library at the University of Idaho in Moscow.  As I previously indicated, the ICC was eliminated in 1996 by an Act of Congress.  Should you be further interested, the U.S. Court of Appeals’ Opinion on our appeal can be found at 35 F.3d 585 (D.C. cir. 1994).  Volume 35 of the Federal Reporter can normally be found at any county law library or is available at the Law Library in Moscow.
