PEABODY IN THE CAMAS PRAIRIE ABANDONMENT CASE Attached for your review is a recent letter from Joe Plaistow of L.E. Peabody. In his letter, he generally inquires whether the Commission could provide additional compensation so that the Company might recover $6,317.06 representing the unpaid amount of Peabody’s billing. As the Commission may remember, the Peabody contract was in two major parts. The first part (for $30,000) was to evaluate the Railroad’s case, perform track and bridge inspections, appear at the PUC hearing, present testimony at the PUC hearing. The second part (for an additional $35,000) was to prepare verified statements for the STB proceeding, evaluate CP’s reply statements, and assist in post-hearing motions. The total amount of the contract was $65,000. In the attached letter, Joe outlines the three areas which caused the Company to under estimate the balance of the work to be performed at the time the contract was amended for Part II. Would the Commission like to discuss this matter? Does the Commission desire to increase the compensation to cover any of the three areas identified in Joe’s letter? vld/M:Plaistow_dh
