On May 9,2019 the Idaho Public Utilities Commission voted to submit to the Division of
Financial Management Notice of Omnibus Rulemaking for IDAPA 31. The Commission is
requesting that all IDAPA 31 rules be re-authonzed as temporary and proposed with the
exception of IDAPA 31.51.02 Automatic Dialing and Announcement Devices (ADADs) Rules.
The ADAD Rules are antiquated and are no longer relevant. The Federal Communications
Commission (FCC) has rules contained within CFR 64.1200 Subpart L - Restrictions on
Telemarketing Solicitation, and Facsimile Advertising Rules - which supersede this rule set and
accomplish the same end goal. The FCC is also better positioned technically and financially to
address complaints in this area.
