KLEIN DEPUTY ATTORNEY GENERAL DATE: APRIL 4,2018 SUBJECT:SUSPENDING INTERMOUNTAIN GAS COMPAI{'Y'S PROPOSED CHANGES, AS SUBMITTED IN THE COMMISSION'S IIWESTIGATION INTO THE IMPACT OF F'EDERAL TAX CODA REVISIONS ON UTILITY COSTS AND RATEMAKING * CASE NO. GNR.U.l8-OI. On March 23,2018, Intermountain Gas Company applied to decrease rates, effective April 1, 2018, to reflect the impact of the federal tax code revisions. Because the Company filed its Application less than 30 days before the new rates were to take effect, Idaho Code $ 6l-307 precludes the Company from making the proposed changes until 30 days after the Application was filed; i.e., until April 23,2018, See ldaho Cade $ 6l-307 and Rule 123 ofthe Cornmission's Rules of Procedure, IDAPA 31.01.01.123. This case will likely extend beyond April 23, 2018. Staffthus recommends the Commission suspend the Company's April l, 2018 proposed effective date for 30 days and five months (i.e., until October l, 2018), or until the Commission othenrrise accepts, rejects, or modifies the proposed changes. ,See Idaho Code $$ 5l-622 and -623. The Company concurs with Staff s suspension recommendation.
