DBA FRONTIER MOTEL-FRONTIER SHUTTLES FOR COMMON/CONTRACT CARRIER AUTHORITY. ) ) ) ) ) ) ) CASE NO. M-8236-1 ORDER NO.  27101 On June 28, 1996, this Commission issued Order No. 26502 in this case granting MKL, Inc. dba Frontier Motel-Frontier Shuttles (Frontier) IPUC Permit No. 8236 for authority to operate as a common/contract carrier providing transportation of passengers. Subsequent to the issuance of Order No. 26502, it was brought to Commission’s attention that Frontier transports passengers solely for the purpose of delivering them from Frontiers’ Motel to the Boise airport.  Idaho Code § 61-801(k)(3) provides: (k).  Exemptions.  Not withstanding the definition of “motor carrier” as defined in this section, the following transportation shall be exempt from regulation by and payment of fees to the Commission: … (3).  Motor vehicles owned or operated by or on behalf of hotels and used exclusively for the transportation of hotel patrons between hotels and local railroads or airports or other common carrier stations. On April 1, 1997, Frontier submitted a letter to the Commission’s Regulated Division certifying that it transported passengers solely for the purpose of delivering them from Frontier’s Motel in Cambridge, Idaho to the Boise airport which, Frontier states, is the “local” airport for the Cambridge area.  We find that the Boise airport is the local airport for Cambridge, Idaho as far as Idaho Code § 61-801(k)(3) is concerned.  Consequently, Frontier is exempt from regulation by this Commission so long as it limits its motor carrier activities to the transportation of persons from its hotel in Cambridge to the Boise airport.  IPUC Permit No. 8236 is hereby revoked. O R D E R IT IS HEREBY ORDERED that IPUC Permit No. 8236 issued to MKL, Inc. dba Frontier Motel-Frontier Shuttles is revoked. THIS IS A FINAL ORDER.  Any person interested in this Order (or in issues finally decided by this Order) or in interlocutory Orders previously issued in this Case No. M-8236-1 may petition for reconsideration within twenty-one (21) days of the service date of this Order with regard to any matter decided in this Order or in interlocutory Orders previously issued in this Case No.  M-8236-1.  Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration.  See Idaho Code § 61-626.
