On August 22, 1997, the Commission Staff filed a Motion for an Order to Show Cause why Mr. Loren Troyer, dba Sea Breeze Trucking, should not be required to submit to a compliance review by the Commission Staff pursuant to Rule 12.01(c) of the Commission’s Motor Carrier Rules, IDAPA 31.61.01.000; Rule 227 of the Commission’s Rules of Procedure, IDAPA 31.01.01.000; Idaho Code § 61-610 and; the affidavit of Mr. Robert Horton
The affidavit of Mr. Robert Horton, an employee of the Commission’s Regulated Carrier Division, states that Mr. Troyer was granted motor carrier authority in January 1996. He has never satisfactorily completed a compliance review, however. Moreover, Mr. Horton’s affidavit indicates that Mr. Troyer has failed to respond to repeated requests by Commission Staff to arrange for such a compliance review and has generally failed to cooperate with the Staff in this regard.
Based upon the affidavit of Mr. Horton, we find that Mr. Troyer shall submit to a compliance review no later than September 19, 1997, or be subject to the penalties set forth in Title 61, Chapter 7 of the Idaho Code. Moreover, the failure of Mr. Troyer to comply with this Order shall result in the revocation of Sea Breeze Trucking’s Motor Carrier Permit No. 8195.
O R D E R
IT IS HEREBY ORDERED that the Commission Staff’s Motion for Order to Show Cause is hereby granted as set forth above.
