On September 27, 1995, this Commission issued Order No. 26175 granting a conditional motor carrier permit to Rojo Company for a one-year period which expired on October 23, 1996.  On December 24, 1996, Staff conducted a compliance review of Rojo and, because of violations discovered, Rojo did not receive a satisfactory rating as required by that Order.  Rojo was notified by letter on December 30, 1996, that its conditional permit was null and void.  
On January 7, 1996, Rojo submitted a written request to the Commission seeking a six month extension providing the opportunity to upgrade its conditional rating to a “satisfactory.”  After reviewing the matter, the Commission Staff believes that Rojo has the intent to comply with the requirements necessary to obtain a satisfactory rating and that it would be reasonable to allow the Company an additional six months in which to satisfy those requirements.  
F I N D I N G S
On the basis of the information presented to us, we find that it would be reasonable to extend Rojo’s conditional permit for a period of six months from the date of this Order.  The Commission Staff is directed to conduct a compliance review after the expiration of the six-month extension period.  If Rojo does not receive a satisfactory rating, then its Motor Carrier Permit No. 8168 shall be automatically deemed null and void.
O R D E R
IT IS HEREBY ORDERED that the conditional Motor Carrier Permit No. 8168 of Rojo Company is hereby extended for a period of six months from the date of this Order.  The Commission Staff is directed to conduct another compliance review after the expiration of the six-month extension period if Rojo does not receive a satisfactory rating during the course of the compliance review, its permit will automatically be deemed to be null and void.
