Stipulation
COMES NOW the Idaho Public Utilities Commission, by and through its attorney, Brad M. Purdy, Deputy Attorney General and Via Expediter’s Inc. who stipulate and agree as follows:
1. Via Expediter’s Inc., PO Box 190142, Boise, ID 83719-0142, is engaged in the business of transporting general commodities as a “common carrier” as that term is defined in Idaho Code § 61-801(f).
2. Via Expediter’s, Inc. underwent a compliance review in July 1996, at which time it received a conditional rating.
3. On April 3, 1995, the Idaho Public Utilities Commission issued Order No. 25946 granting Via Expediter’s, Inc. conditional authority to operate within the state of Idaho as a common carrier. That authority expired on June 29, 1996.
Agreement
1. Via Expediter’s, Inc. agrees that it is attempting to achieve a satisfactory safety rating and that it will take whatever action is necessary to obtain such a rating no later than April 1, 1997.
2. Via Expediter’s, Inc. agrees that in the event it fails to obtain a satisfactory safety rating by April 1, 1997, that it forfeits its right to operate within the state of Idaho as a common carrier.
3. The Staff of the Idaho Public Utilities Commission and Via Expediter’s, Inc. agree to an extension of the conditional authority to operate as a common carrier for Via Expediter’s, Inc. until April 1, 997.
