M-7389-5 ORDER NO.  27133 “B” Transfer, Inc., 890 Airbase Road, Mountain Home, Idaho 83647 applied to the Idaho Public Utilities Commission on July 28, 1997 for authority to voluntarily suspend its motor carrier permit for 12 months.  “B” Transfer was already under a 24 month suspension granted by the Commission in Order No. 26120.   FINDINGS OF FACT The Idaho Public Utilities Commission has jurisdiction over the above entitled matter by virtue of Idaho Code § 61-808.  “B” Transfer, Inc. is the holder of IPUC Permit No. 7389.  Said Permit No. 7389 presently authorizes “B” Transfer to transport general commodities within the state of Idaho.  “B” Transfer, Inc. has requested this Commission to suspend its permit for a period of 12 months beginning July 28, 1997 stating just and sufficient grounds.  IPUC Permit No. 7389 should be suspended for a period of 12 months. O R D E R IT IS HEREBY ORDERED that IPUC Permit No. 7389 presently held by “B” Transfer, Inc. be and the same hereby is suspended for 12 months from July 28, 1997.   IT IS FURTHER ORDERED that “B” Transfer, Inc. may remove the suspending Order during said stated period only by a written request to, and authority from, this Commission. IT IS FURTHER ORDERED that so long as IPUC Permit No. 7389 is on suspension under this Order, it shall be unlawful for “B” Transfer, Inc. to conduct motor carrier service within the state of Idaho.   IT IS FURTHER ORDERED that at the conclusion of the suspension period, this permit will be subject to automatic reinstatement upon compliance with all statutes and Commission rules and regulations governing motor carriers.  If such compliance is not received within 30 days after July 28, 1997, the Commission may continue the suspension and initiate a complaint against “B” Transfer, Inc. for said violations or compliance failure. THIS IS A FINAL ORDER.  Any person interested in this Order (or in issues finally decided by this Order) or in interlocutory Orders previously issued in this Case No. M-7389-5 may petition for reconsideration within twenty-one (21) days of the service date of this Order with regard to any matter decided in this Order or in interlocutory Orders previously issued in this Case No. M-7389-5.  Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration.  See Idaho Code § 61-626.
