CASE NO. GNR-M-97-2
ORDER NO. 27733
On May 27, 1997, the Commission issued Order No. 26940 temporarily suspending Rules 41.02(a) and 41.03(a) of the Commission’s Motor Carrier Rules (IDAPA 31.61.01.000 et seq.) pertaining to the financial fitness and ability of applicants for a motor carrier permit issued by this Commission. The Commission’s Order was in response to the 1995 enactment of federal legislation preempting the regulation by states of the economic activities of motor carriers.
The Commission ultimately removed Rules 41.02(a) and 41.03(a) permanently from its Motor Carrier Rules. Consequently, the objective of this case has been satisfied and it is appropriate that the docket now be closed.
O R D E R
IT IS HEREBY ORDERED that Case No. GNR-M-97-2 is closed
THIS IS A FINAL ORDER. Any person interested in this Order (or in issues finally decided by this Order) or in interlocutory Orders previously issued in this Case No. GNR-M-97-2 may petition for reconsideration within twenty-one (21) days of the service date of this Order with regard to any matter decided in this Order or in interlocutory Orders previously issued in this Case No. GNR-M-97-2. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. See Idaho Code § 61-626.
