On April 25, 1997, this Commission issued Order No. 26896 temporarily suspending all those portions of the Commission’s Motor Carrier Rules (IDAPA 31.61.01.000 et seq.) pertaining to “safety ratings.” The Commission’s Order was in response to a federal court ruling that the Federal Highway Administration’s safety rating methodology, upon which this Commission relied in issuing safety fitness ratings, was unlawfully implemented.
The Commission ultimately permanently removed all those portions of its Motor Carrier Rules pertaining to safety fitness ratings. Consequently, the objective of this case has been satisfied and it is appropriate that we now close this docket.
O R D E R
IT IS HEREBY ORDERED that Case No. GNR-M-97-1 is closed.
THIS IS A FINAL ORDER. Any person interested in this Order (or in issues finally decided by this Order) or in interlocutory Orders previously issued in this Case No. GNR-M-97-1 may petition for reconsideration within twenty-one (21) days of the service date of this Order with regard to any matter decided in this Order or in interlocutory Orders previously issued in this Case No. GNR-M-97-1. Within seven (7) days after any person has petitioned for reconsideration, any other person may cross-petition for reconsideration. See Idaho Code § 61-626.
