RE:UNAUTHORIZED OPERATION AS A PASSENGER MOTOR CARRIER BY CHRISTOPHER P. SIMPSON AND SIMPS 4 INC DOING BUSINESS AS BALD MOUNTAIN TAXI
The Motor Carrier Division has received information to believe that Christopher B. Simpson and Simps 4 Inc, doing business as Bald Mountain Taxi (“Simpson”) are operating a passenger motor carrier service without authority from the Commission. Simpson filed an Application with the PUC last November and in January the PUC issued an Order approving Simpson’s Application conditioned upon his compliance with insurance and safety review requirements. When Simpson failed to provide proof that he had acquired insurance and a satisfactory safety rating, the Commission on February 27, 1996, mailed a notice to Simpson that the Order approving his Application no longer was valid. Apparently Simpson continues to provide passenger motor carrier service from Blaine County, Idaho.
Staff believes it is appropriate to take legal action against Simpson and Simps 4 Inc. However, before a lawsuit is filed in Blaine County District Court, it may be prudent to file a show cause Order from the Commission requiring Simpson to respond to Staff’s allegation that Simpson is operating illegally.
Commission Decision
Should the Commission issue an Order to show cause directing Simpson to answer the allegation that he is operating a passenger motor carrier service without authority from the Commission?
