INT-G-98-3 NOTICE OF APPLICATION NOTICE OF MODIFIED           PROCEDURE NOTICE OF COMMENT/ PROTEST DEADLINE ORDER NO. 27517 YOU ARE HEREBY NOTIFIED that on April 30, 1998, Intermountain Gas Company  (IGC; Company) filed with the Idaho Public Utilities Commission (Commission) the Company’s proposed Standards for Competitive Practices which, if approved, will become Section E of its General Service Provisions (see attachment).   As proposed, the Standards for Competitive Practices will apply to transactions, direct or indirect, between Intermountain Gas Company, its customers and gas marketing companies.  The Company states that the standards proposed have been followed by it for at least the past two years, as the Company has operated in an open-access environment.  To the extent, it states, that such standards exceed the jurisdiction of the Commission, IGC agrees to voluntarily comply with them.  With these additions, the Company contends that its General Service Provisions will continue to be fair, just, reasonable, and consistent with the requirements of Idaho Code § 61-315 which prohibits discrimination and preferential treatment. YOU ARE FURTHER NOTIFIED that the Commission has determined that the Company’s filing should be treated as a formal Application with a case established for public comment and participation. YOU ARE FURTHER NOTIFIED that the Commission has reviewed the proposed Standards for Competitive Practices.  The Commission has preliminarily found that the public interest regarding the proposed standards may not require a hearing to consider the issues and that the Application may be processed under Modified Procedure, i.e., by written submission rather than by hearing.  Reference Commission Rules of Procedure, IDAPA 31.01.01.201-.204. YOU ARE FURTHER NOTIFIED that the Commission will not hold a hearing in this proceeding unless it receives written protests or comments opposing the use of Modified Procedure and stating why Modified Procedure should not be used.  Reference IDAPA 31.01.01.203. YOU ARE FURTHER NOTIFIED that the deadlinefor filing written comments or protests with respect to the Application and the Commission’s use of Modified Procedure in Case No. INT-G-98-3 is Friday, June 26, 1998.  Persons desiring a hearing must specifically request a hearing in their written protests or comments. YOU ARE FURTHER NOTIFIED that if no written comments or protests are received within the deadline, the Commission will consider the matter on its merits and enter its Order without a formal hearing.  If comments or protests are filed within the deadline, the Commission will consider them and in its discretion may set the matter for hearing or may decide the matter and issue its Order on the basis of the written positions before it.  Reference IDAPA 31.01.01.204.
