REQUESTING A LANGUAGE MODIFICATION ON THE TITLE PAGE OF ITS
TARIFF FOR THE COOPERATIVES (COOPS) OF IDAHO.
BACKGROUND
Recently the Idaho Telephone Association (ITA) filed a revised IREC tariff updating
tenns and conditions for the IT A companies in Idaho. This filing was a housekeeping measure
and was approved by the Commission. Upon completion of the approval Staff suggested that the
Cooperatives be removed from the tariff, as this Commission, by statute, does not have
jurisdiction over their services or rates.
DISCUSSION
After working with the ITA member s consultants and counsel, a compromise was
reached wherein a disclaimer was added to the title page of the IREC TariffNurnber 3. It reads
as follows:
The following companies are telephone cooperatives, and neither their
rates or service offerings are subject to Commission jurisdiction. Their
rates are listed in this tariff for the convenience of the public and for
infonnational purposes only.
Custer Telephone Cooperative, Inc.
Fanners Mutual Telephone Company
Filer Mutual Telephone Company
Mud Lake Telephone Cooperative Association, Inc.

It was noted that the Coops appreciate being able to have their rates and services listed in
one source so they do not have to maintain an entire tariff on their own.
STAFF RECOMMENDATION
Staff believes the language added to the tariff is effective and addresses the concern Staff
had with respect to this Commission s jurisdiction for the Cooperatives. Staffrecornrnends
approval of the language.

Does the Commission wish to approve the language modification to the IREC tariff
effective May 15 , 2003?
