CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY,
CERTIFICATE NO. 346. CASE NO. GNR-97-24.
On March 17 2003 Western Wireless Corporation filed a request to amend Eclipse
Communications ' Certificate of Public Convenience and Necessity No. 346 to reflect the
Company s name change to Western CLEC Corp. This Certificate was issued to Eclipse
Communications on September 1998. See Order No. 27536, Case No. GNR-97-24.
BACKGROUND
Eclipse Communications is a subsidiary of Western Wireless. Western Wireless
represents that Eclipse does not currently provide service to customers in the State of Idaho and
does not generate revenue or have facilities in the State. Furthermore, Western Wireless
contends that as of January , 2000 Eclipse notified the Commission in writing regarding the
change of its name to Western CLEC Corp. Since that time Eclipse s regulatory fee and gross
operating revenues report have been completed and submitted to the Commission under the
name Western CLEC Corp.
Western Wireless now requests that the Commission allow its subsidiary, Eclipse
Communications to amend its Certificate No. 346 to reflect its name change to Western CLEC
Corp. Western Wireless represents that this name change does not reflect a transfer or change in
control, ownership or assets and is a change in name only of its subsidiary.
DECISION MEMORANDUM
ST AFF RECOMMENDATION
Staff believes that the Commission may accommodate the Company s request, which
is an administerial change, without resorting to Modified Procedure.Staff also notes that
Western CLEC Corp. has a current Certificate of Authority to transact business as a foreign
corporation in this State. Staff recommends that Certificate No. 346 be amended to reflect that
Eclipse Communications Corp. has changed its name to Western CLEC Corp.
COMMISSION DECISION
Does the Commission wish to authorize Eclipse Communications Corporation to
amend its Certificate No. 346 to reflect the Company s name change to Western CLEC Corp.
