Re: In the Matter of the Petition of Intermountain Gas Company for a Declaratory Order
Relating to the Resale of Natural Gas. Case No. INT -G-1e-e1. Order No. 31e36.
The Treasure Valley Clean Cities Coalition (TVCCC) supports Intermountain Gas Company's
interest in seeking an order from the Commission stating that the Commission lacks "economic
jurisdiction of the resale of natural gas by third party non-utilities for use in motor
vehicles. "
The TVCCC is a local group of advocates for the use of al ternati ve fuels. This Coalition and
others like it across the county believe that increasing the availability of alternative
fuels, such as compressed natural gas (CNG), will reduce the United States' dependence on
imports of foreign oil, improve air quality, and promote local economic development. CNG is
gaining favor as a vehicle fuel nationwide and is publicly sold in many other states. The
approval of Intermountain Gas Company' s petition will not only help create opportunities to
expand the market for CNG as a vehicle fuel in Idaho, but will assist market development
across the country.
Although Section 4e4 of the Energy Policy Act of 1992 appears to restrict the PUC's
jurisdiction over the resale of natural gas as a transportation fuel, an affirmative action
in this matter by the Idaho PUC will clarify the situation and greatly assist with the
ability to establish a CNG infrastructure in Idaho.
