MISCELLANEOUS:
Provided that if the installation of a private fire

Meters may be placed on fire services by the uti Ii ty atany time, however, metered rates wi 11 not apply unless improper
use of water is disclosed, and if such be the case, usage will
be billed to the consumer under Rate Schedule No.

MUNICIPAL FRANCHISE FEES
PURPOSE
The purpose of this schedule is to set forth the charges such as license, privilege, fi-anchise, business
occupation, operating, excise, sales or use of street taxes or other charges imposed on Eagle Water
Company by municipal corporations, and billed separately by the Company to its Customers within the
corporate limits of a municipality.
APPLICABILITY
This schedule is applicable to all bills for Water Service that have been calculated under the Company
service schedules as filed with the Idaho Public Utilities Commission, and is limited to such service
provided by Eagle Water within the corporate limits of the respective municipality located in the
Company s service area.
CHARGE
The rates and charges for Water Service provided under the Company s schedules will be proportionately
increased by the following charge for customers located within the respective municipality on and after
the effective date of the charge for the applicable municipal ordinance, which charge will be separately
stated on the customer s regular billing.

The Customer, in recei vlng water service, and the Company,
in providing water service, both agree to abide by these
Rules and Regulations.
In the event that there is a conflict between the Com-
pany s Rules and Regulations and the Rules and Regulations
of the Idaho Public utilities Commlssion concerning Water
Companies, the Rules and Regulations of the Commisslon
shall take precedence unless an exception has beengranted.
Any addi tions, deletions or modifications to these General
Rules and Regulations are subject to approval by the
the Cornmisslon prior to becoming effective.
DEFINITIONS

APPLICATION FOR ERVICE
The Company shall furnish service to applicants wi thin
its service area under the jurisdiction of the Commlssion
in accordance with rates and Rules and Regulations
approved by the Commisslon.
Special contracts may be required where large investments
in special facilities are necessary to provide the re-
quested service. The Company may require a contribution
in aid of construction and may establish such mInimum
charges as are deemed necessary. All such contracts are
subject to the approval of the Commisslon.
The Company reserves the right to place limi tat ions
the amount and character of water service it will supply
and to refuse service to new Customers if, in its opinlon:

The Company is required to refuse or limit service
by regulatory authorities having jurisdiction over
the Company;
The requested service would adversely affect the
water supply of or otherwise work an undue hardship
on existing Customers or the Company;
The requested service installation is of larger size
than is adequate to properly serve the premises.
The permanency of the bui Iding, structure or insti tu-
tion requested to be served is such that the Com-
pany s investment in such service is jeopardized;
The requested service connection will serve more than
one building or premise;
The depth of the Customer s service line is less than
the minlmum depth required for frost protection.

The proposed service, main or other appurtenance does
not conform to good engineering design or meet the
standard specifications of the Company.
(h)The Customer refuses to agree to abide by the Rules
and Regulations of the Company.
All appl icants for water service, as well as the owners
or authorized agent of the owner of the premises to be
served shall sign a standard form of service application.
If the Company denies service to a potential Customer
for any reason, it will immediately provide the applicant
wi th a wri tten explanation of its decision in accordance
with the Rules governing Customer Relations.
In case of temporary service for short term use, as
distinguished from seasonal use, the Company may requirethe Customer to pay a 11 costs of making the service con-
nection and removing the material after the service has
been disconnected, provided, however, that the Customer
shall be credited with the reasonable salvage which the
Company shall make from the material removed. In anyevent, the amount payable by the Customer wi 11 be fully
grossed-up for the income tax obligation of the Company
on the contribution. The appropriate established rateschedule wi 11 apply for service rendered.
RATE SCHEDULE
When more than one schedule is applicable to the consum-
s service, the Company shall, at the consumer s re-quest, assist in determining the rate most favorable tohim. Any of the Company s rates, if applicable to the
service, may at any time be substituted, at the consumer
option, for the rate under which service is rendered;provided that not more than one substi tution of a rate
may be made within any period of twelve consecutive months
and further that such change shall not be retroactive.

Rates charged for water service and supply shall be those
published in the Company s tariff and approved by theCommisslon.
If the Customer is eligible for billing under more than
one (1) rate schedule, see the Rules of Customer Rela-tions.
BILLING AND PAYMENTS

All Customers will be billed on a regular basis
identified on the applicable rate schedule.
The Company sha 11 endeavor to have each meter read at
approximately monthly intervals to determine the cost ofwater. In the event the Company s meter reader is unable
to gain access to the premises to read the meter on his
regular trip, or in the event the meter fails to register
the Company may estimate the consumer s water consumption
for a prior similar period, or average of several periods.
Subsequent readings will automatically adjust for differ-
ences between est ima led and actual. Estimated bi lIs shall
carry appropriate notice to that effect.
All bi lIs sha 11 clear ly indicate ba lance due and sha 11 be
due and payable within 15 days of the date rendered. All
bills not paid within 15 days shall be considered delin-quent and service may be di sconnected subj ect to the pro-
vislons of the Rules of Customer Relations.
The mInimum bi 11 or customer charge sha 11 apply when ser-
vice is provided for less than one month.
Owners of premises wi th one or more condomlniums, bui Id-
ings, stores, apartments or any other divlsions of like or
similar character, all of which are served from one (1)
service connection are responsible for the entire watercharges. If the owner desires to cease being responsible
for water bills for such places and desires that the
occupant of each divislon shall be responsible for his or

her respective bill, such transfer of responsibility will
not be accepted or recognized by the Company unti 1 theplumbing arrangements of the bui Iding or premises are so
changed by the owner or his or her agent as to permi t the
Company, to its satisfaction, to serve each division or
occupant separately from the other occupants in the same
bui Iding. Where an owner refuses to make the necessary
plumbing changes to conform to the above requi rements and
will not accept the responsibility for payment of the
entire water charges, water service will be disconnected
until said requirements are complied with.
Water service is subject to disconnection for non-payment
of delinquent bills.
Accounts wi 11 be cont inued and water bi lIs rendered
regularly until the Company has been duly notified by
Customer to discontinue service. Fai lure of the Customer
to request discontinuance of service shall not be grounds
for adj ustment of charges by the Company. The Customer
will be responsible for the payment of all service pro-
vided prior to receipt of such notice. The Company will
make the final reading of the meter within reasonable
time after Customer notification.
The consumer shall reimburse the Company for his propor-
tionate part of any franchise tax or charge or any in-
crease in such tax or charge (other than ad valorem and
income taxes) assessed, imposed or levied against the
Company with respect to water delivered hereunder as aresult of any law, amendment of law, order or regulation
of any governmental authority.
DEPOSITS
The Company, at this time, does not charge a deposit for
a condi tion of service.

METERING
Issued
The representative of the Company shall be given access
to the premises of the consumer at all reasonable hours
for obtainlng meter readings, for shutting off the flow
of water for reasons herein prescribed, for inspection of
piplng and appliances, and for inspecting, removing,
repairlng or protecting from abuse or fraud any of the
property of the Company installed on the premises. Accessshall be granted at all times for emergency purposes. TheCompany may refuse water service, or suspend it, on re-
fusal of legitimate access to the property. In the eventof recurring inaccessibility, the Company, at its option,
may relocate its metering equipment at the consumerexpense.
The Company is responsible for the maintenance of itsmetering equipment. Meters are considered to be suffi-
ciently accurate if tests indicate that meter accuracyis wi thin ~ 2 percent. When for any reason a meter fai
to register wi thin these limi ts of accuracy, the Custom-
s use of water will be estimated on the basis of avail-
able data and charges will be adjusted accordingly.
Corrected bills will then be sent out to the Customer
and addi tional payment or refund arrangements made in
accordance wi th the Rules of Customer Relations.
The Company reserves the right to test and/or replace anymeter. If the test indicates that the meter over-
registers by more than 2 percent, it will be replaced
wi th an accurate meter at no cost to the Customer, andwater bi lIs wi 11 be adj usted in accordance wi th the Rules
of Customer Relations.
Water supplied to a Customer under any of the Company
rate schedules is for the sole use of such consumer and
shall not be remetered or submetered for sale to others;nor shall the water be piped across or along public

streets, roads or alleyways beyond the confines of said
consumer s premises for use at other locations, without
first obtaining wr i tten permisslon f rom the Company.
The Company shall have the right to set meters or other
devices wi thout notice to the Customer for the detection
and prevent ion of fraud.
When service is supplied to duplexes or apartments under
single ownership located on contiguous property, suchservice may be supplied through a sing Ie meter.
At the Company s option, service may be supplied through
more than one meter on the consumer s premises.
CONSUMER PLUMBING AND APPLIANCES

All plumbing, plping, fixtures and app 1 i ances on theconsumers side of the service connection shall be
installed and malntained under the responsibility and
at the expense of the consumer or owner of premises.
The Customer s plumbing, Plping, fixtures and appliances
shall be installed and malntained in conformity with all
munlcipal, state and federal requirements. The nature
and condi t ion of this plumbing, Plping and equipment
shall be such as not to endanger life or property, inter-
fere wi th service to other Customers or permi t those wi metered services to divert system wa ter wi thout meterregistration. No Customer connection or arrangement will
be permitted which could result in an unsafe or aestheti-
cally objectionable substance entering the Companywater system. If there is any violation of these con-di tions, the Company may refuse service or discontinueservice wi thout notice unti 1 such violations are remedied
by the consumer.

A stop-and-waste va 1 ve must be insta lIed on the Customer'plumbing in a place always accessible and so located
to permit shutting off the water for the entire premises
wi th the least possible delay.
All persons having boi lers, water tanks or other equip-
ment supplied by direct pressure from the Company s mainsshould install a pressure relief valve, or other device
to serve the same purpose, so as to prevent access pres-
sure from forcing hot water and/or steam back into the
water meter and mains of the Company. All damage to theCompanys property resulting from failure to properly
equip Customer plumbing with a relief valve shall bebi lIed to the Customer.
The Company is not obligated to perform any service what-

When the premises served by the Company is also served inany manner from another water supply of any kind, anapproved backflow prevention device shall be installed at
the service connection. Water service for either stand-
or other purposes will not be furnished until piping and
connections are inspected and approved by a representative
of the Company.
Any facility or facilities, which the Company or any
municipal, state or federal agency determines to be a
potential source of contamination to the Company s watersystem will be required to install protective devices designated by the Company. Such devices will be installed
by a licensed plumber, at the Customer s expense. The
type of device wi 11 be commensurate wi th the degree ofhazard, type of backflow and the availability of qualified
maintenance service. Where requi red, such devices shallbe installed in the Customer s service line in a location
which is readily accessible for periodic inspection andrepair.

For those prevention devices requiring periodic inspection
by any regulatory agency, the Customer is responsible for
the scheduling and performance such inspect ions. Those
devices shall be repaired, overhauled, or replaced at the
expense of the Customer whenever they are found to bedefective. Records of such tests and repairs and over-
hauls shall be maintained by the Customer with copies
forwarded to the Company.
At the Customer s request, the Company may, at its option,
test certain of these devices for a charge based on
current costs covering labor, material and reasonableoverheads. However, any required repairs will not be madeby the Company. It will be the Customer s responsibility
to have the device repaired or replaced by a qualified
licensed plumber.
Property owners will not be allowed to connect the water
service of different properties together.
All of the Customer s service pipes and fixtures must be
kept in repair and protected from freezing at his or her
expense. When there are leaking or defect i ve pipes or
fixtures, the water may be turned off at the option of
the Company unti I the proper repairs are made.
The Customer will assume all responsibility on his prem-
ises for water supplied by the Company. The Company will
be exempt from all liability for loss or damage caused by
leakage or escape of water furnished by the Company, after
the same has passed the point of the Company s ownership.
INSTALLATION OF SERVICE CONNECTIONS
The service connection is the property of the Company and
as such, the Company is responsible for its installationand maintenance. It consists of piping, curbs top andvalve or meter box and a meter, if the service is metered.The service connection transmits water from the Company
water main to a valve or meter box generally located near

the Customer s property line. All Plping, valves orappliances beyond this point are the property and respon-
sibility of the Customer.
The Company reserves the right to designate the size andlocat ion of the service ine, curbstop, meter (i f app 1 i-
cable) and meter or valve box and the amount of space
which must be left unobstructed for the installation and
future maintenance and operation thereof.
The Customer shall obtain and grant all necessary permis-
sion to enable the Company to install the service line
the property line. The Company shall have the right
through its agents, or other employees, to enter upon the
premises of the Customer at all times for the purpose of
reading, inspecting, repal ring, or moving the metering
devices, and other pipes and fixtures of the Company.
Where a service connection is desired for a premises on
which there is no permanent structure, the Company will
install a service connection to said premises only upon
payment by the applicant of the estimated cost of said
service connection. If, within a period of five (5) years
from the installation of said service connection, a per-
manent structure is erected on the premises, the Companywill refund, with interest, the difference between any
approved new Customer charges in effect at the time ofconnection, and the applicant's advance.
The extra costs of any out-of-the-ordinary circumstances
requirlng additional equipment or special construction
techniques involved in the installation of a service
connection will be agreed to in advance by the Customer
and the Company.
10. REPLACEMENT OR ENLARGEMENT OF SERVICE CONNECTIONS

(a)Whenever it is necessary to change the location of
any service connections due to relocation or abandon-
ment of the Company s mains; and
(b)For commercial or industrial services where the type
or volume of use has changed and the enlargement will
resul t in sufficient increase in annual revenue to
justify the enlargement.
The relocation, enlargement or reduction of service
connections for the convenience of the Customer wi 11 beat the expense of the Customer. Prior to such relocation,
enlargement, or reduction, the Customer will deposit theestimated cost thereof wi th the Company, including a
gross-up for the income tax obligation of the Company on
the contribution. Within fifteen (15) days a refund will
be made to the Customer in the amount by which the esti-
mated cost exceeds the actual cost, including the income
tax obligation. The amount by which the actual cost
exceeds the estimated cost shall be due and payable withinfifteen (15) days after billing for such deficiency.
Enlargement or reduction of any service connection will
be made only after such time as the Customer s plumbing
inside his premises have been enlarged sufficiently toaccommodate the addi tional capaci ty.
11. SERVICE PIPING ON CUSTOMER. S PREMISES

The use of water through an unmetered private fire
service, except for testing purposes, is not allowed.
The Company may, at its option, seal the valves on such
fire lines or place meters at any time. Any violation
of this regulation shall be sufficient cause for the
Company to discontinue the service until satisfactory
arrangements have been made concerning the payment for
water drawn from such fire service in the past and up
unt i 1 the time of di sconnect ion. The Company may, wi
the consent of the Customer, connect to the private fire
line to supply domestic water for the same premises.

When a Customer desires to discontinue service he shall
give notice to the Company at least two (2) business days
in advance and shall be responsible for all water consumed
for the two (2) business days after the date of suchnotice.
The Company may discontinue a Customer I s service on an
involuntary baS1S only in accordance wi th the Rules of
Customer Relations.
When it becomes necessary for the Company to involuntarily
discontinue water service to a Customer, service wi 11 be
reconnected only after all bills for service then due have
been paid or satisfactory payment arrangements have been
made.
A reconnect ion fee will be charged when a Customer isreconnected after having been disconnected, ei ther volun-
tarily or involuntarily, at the same premises. A charge
of $15.00 to cover the expense wi 11 be made for restoring
service during normal working hours, 8: 00 a. m. to 4: 30
m., Monday through Friday, excluding holidays. A charge
of $30.00 will be made to cover the expense of restoringservice at a 11 other times. Reconnect ion fees wi 11 not be
charged for any situation or circumstance in which the
Customer s water supply is disconnected by the Company for
its convenience.

The Company reserves the right at any time, upon notice,
to shut off the water for maintenance or expansion and,in emergencies, may do so without notice. The Company
shall at all times use reasonable diligence and care to
prevent interruption of said water service.

or turn-off the water on the Company s side of the serviceconnection.

agreement, the estimated net cost of relocating rais-
ing or lowering facilities upon establishment of fi-nal grades. Adjustment of any difference between the
amount so deposi ted and the actual cost of relocating
raising or lowering facilities shall be made withinten days after the uti Ii ty has ascertained such
actual cost. The net deposit representing actual
cost is not subject to refund. The entire deposit
related to the proposed relocation, raising or low-
ering shall be refunded when such displacements aredetermined by proper author i ty to be not requi red.

the costs recorded in conformity with generallyaccepted water uti Ii ty accounting and sound engineer-
ing practices, and as specifically defined in the
Uniform System of Accounts for Water Utilities pres-
cribed by the Commission, of installing facilities
of adequate capaci ty for the service requested. If
the utility, at its option, should install facilities
with a larger capacity or resulting in a greater
footage of extension than required for the servicerequested, the "adjusted construction cost", for the
purposes of this rule, shall be determined by the
application of an adjustment factor to actual con-
struction cost of facilities installed. This factor
shall be the ratio of estimated cost of required

Any facilities installed hereunder shall be the sole
property of the utility. In those instances in which
title to certain portions of the installation, such
as fire hydrants, will be held by a political sub-
divislon, such facilities shall not be included as a
part of the main extension under this rule.
The size, type, quality of materials, and their loca-
tion shall be specified by the utility; and the
actual construction shall be done by the utility or
by a constructing agency acceptable to it.
Where the property of an applicant is located adj a-
cent to a right-of-way exceeding 70 feet in width,
for a street, highway or other public purpose, re-
gardless of the width of the traveled way or pave-
ment; or a freeway, waterway or railroad right-of-way
the utility may elect to install a main extension on
the same side thereof as the property of the appli-
cant, and the estimated and adj usted construction
costs in such case shall be based upon such an exten-sion.
When an extension must comply wi th an ordinance,
regulat ion, or speci f icat ion of public authori ty, the
estimated and adjusted construction costs of said
extens ion sha 11 be based upon the f aci 1 i ties requi redto comply therewi th.

Any applicant for a main extenslon requesting the
utility to prepare detailed plans, specifications,
and cost estimates shall be required to deposit with
the utility an amount equal to the estimated cost of
preparation of such material. The utility shall,
upon request, make avai lable wi thin 45 days after
receipt of the deposi t referred to above, such plans,
specifications and cost estimates of the proposed
main extension. If the extension is to include over-
sizlng of facilities to be done at the utility
expense, appropriate details shall be set forth in
the plans, specification and cost estimates.
In the event a main extension contract wi th the
utility is executed within 180 days after the utility
furnishes the detailed plans and specifications, the
deposit shall before a part of the advance, and shall
be refunded in accordance with the terms of the main
extension contract. If such contract is not so
executed, the deposit to cover the cost of preparing
plans, specifications and cost estimates shall beforfei ted by the applicant for the maln extension and
the amount of the forfeited deposit shall be credited
to the account or accounts to which the expense of
preparing said material was charged.
When detailed plans, specifications and cost esti-
mates are requested, the applicant for a main exten-
sion shall furnish a map to a suitable scale showing
the street and lot layouts and, when requested by theuti Ii ty, contours or other indication of the relative
elevation of the various parts of the area to be
developed. If changes are made subsequent to the
presentation of this map by the applicant, and thesechanges require addi tional expense in revislng plans,speci f ications and cost estimates, thi s addi t iona 1
expense shall be borne by the applicant, not subject
to refund, and the additional expense thus recovered
shall be credited to the account or accounts to which
the additional expense was charged.

Unless the applicant for the main extension elects to
arrange for the installation of the extension him-
self, as permitted by Section 3l.1C, the full amount
of the required contribution must be provided to the
utility at the time of execution of the main exten-
sion agreement.
An applicant for a main extension who contributes
funds shall be provided wi th a statement of actual
construction cost and adjusted construction costshowing in reasonable detai 1 the cost incurred formaterial, labor, any other direct indirect costs,overheads, and total costs; or uni t costs; or con-
tract costs, whichever are appropriate.
Said statement shall be submitted within sixty days
after the actual construction costs of the install-
ation have been ascertained by the utility. In the
event that the actual construction costs for the
entire installation shall not have been determined
wi thin 120 days after the completion of construction
work, a preliminary determination of actual and
adjusted construction costs shall be submitted, basedupon the best avai lable information at that time.
Any di fferences between the adj usted cons t ruct ioncosts and the amount contributed shall be shown as
a revision of the amount of advance and shall be pay-
able within thirty days of submission of statement.
Interpretations and Deviations
In case of disagreement or dispute regarding the applica-
tion of any provision of this rule, or in circumstances
where the application of this rule appears unreasonable
to either party, the utility, applicant or applicants may
refer the matter to the Commission for determination.

14. EXTENSIONS TO SERVE INDIVIDUALS

The applicant or applicants for service shall be required
to advance to the utility, before construction is com-
menced, the estimated reasonable cost of the main line
extension exclusive of the cost of service pipes, meter
boxes and meters. Such estimated reasonable cost shall
be based upon the cost of a main not in excess of 6 inches
in diameter except where a larger main is required by the
special needs of the applicant or applicants.

15.Contributions
(a)An applicant for a main extension to serve a new
subdivision, tract, housing project or industrial
development or organized commercial district shall
be required to make a non-refundable contribution
to the utility, before construction is commenced,
the estimated reasonable cost of the extension to be
actually installed, from the nearest utility facility
at least equal in size or capacity to the main re-
quired to serve both the new Customers and a reason-
able estimate of the potential Customers who might be
served directly from the main extension without
addi tional extension. The costs of the extension
shall include necessary service stubs or service
pipes, fi ttings, gates and housing therefor, and
meter boxes, but shall not include meters. To this
shall be added the cost of fire hydrants when re-
quested by the applicant for the main extension orrequired by public authori ty, whenever such hydrants
are to become the property of the utility.

If, for any purpose, special facilities are required
primarily for the service requested, the cost of such
special facilities may be included in the contribu-tion.
In lieu of providing a contribution in accordance
with 15.1(a) and (b), the applicant for a main
extension shall be permitted, if qualified in the
judgement of the utility to construct and install the
facility himself, or arrange for their installation
pursuant to competi ti ve bidding procedures ini ti ated
by him and 1 imi ted to qua 1 i f ied bidders. The cost,
including the cost of inspection and supervision by
the utility, shall be paid directly by applicant.
The applicant shall provide the utility with a state-
ment of actual construction cost in reasonable de-
tai 1.
No Customer shall permit any person from another premises
to take water from his or her water service tap for more
than one (1) week without the written permission and
consent of the Company.
16.No person acting either on his or her own behalf or as
agent of any person, firm, corporation or municipality,
not authorized by the Company, shall take any water from
any fire hydrant on the Company s system except in the
case of an emergency.
16.No person shall place upon or about any hydrant, gate,
box, meter, meter box or other property of the Company,
any building material or other substance so as to prevent
free access at all times to the same.

Service will be malntained to domestic Customers on apreferential basis. Delivery of water under all schedules
may be restricted, interrupted or curtailed at the dis-
cretion of the Company in case of shortage or threatened
shortage of water.
No rate contract or application is assignable from one
user to another, except upon agreement of all partiesconcerned.
The representative of the Company shall be given access
to the premises of the Customer at all reasonable hours
for obtalning meter readings, for turning on or shutting
off the flow of water, for inspecting, removing, repaIring
or protecting from abuse or fraud any of the property of
the Company installed on the premises. Access shall be
granted at all times for emergency purposes.
No one, except an authorized agent of the Company, shall
tamper wi th, interfere wi th, make repa i rs, connect ions or
replacements of or to any of the Company s property.
The Customer will not materially increase his demand oruse of service wi thout gi vlng due notice of such increase,
especially in cases of unmetered service. In the event of
such increase the Customer wi 11 pay the Company s approved
rates for such increased service. In cases of unmetered
commercial service the Company may determine that the
serVlce should be metered and the Customer will be billed
under the appropriate approved metered rates.
Whenever an applicant desires service of a character for
which there is no available service classification, a
contract may be executed in lieu of a tariff. Any such
contract is subject to the approval of the CommIssion.
16.10 The Customer is held responsible for any violation of
these Rules and Regulations even though the breech
committed by someone employed either directly or indirect-
ly by the Customer.
