(Acceptance Stamp) Termination of Service The Company reserves the right to terminate services in accordance with rules found in IDAPA 31.D. Service Offering Calculation of Distance.Calls are measured, based on airline distance between the rate center of the customer terminal or switch location to the rate center of the destination ofthe call. 1.2 The distance between the rate centers of the customer switch and destinationpoint is calculated by using thevertical ("and horizontal (" coordinates found in AT&T Tariff FCC No. 10, in the following manner. 1.2.Formula Step 1- Obtain the "V" and "H" coordinates for the Subscriber s switch and the destination point. Step 2- Obtain the difference between the " coordinates of each of the rate centers. Obtain the difference between the "H" coordinates. Step 3- 2 . Square the difference obtained in Step Step 4- Add the squares of the "V" difference and "H" difference obtained in Step Step 5- Di vide the sum of the squares obtained in Step 4 by ten (10). Customers, Telephone completion Description of ServicesThe Company endeavors to provide high quali ty service. All network access is moni tored and engineered to provide a01 grade of service (99% call completion ratio). Service is available 24 hours per day, 7 days a week, subjectto routine maintenance and outages beyond the control of the Company. The Company equipment is designed and engineered to provide high quality transmission of voice and data with a minimum level of impairment such noise and echo. However, overall quali ty may vary somewhat due to the variabili ty in quali ty of theconnections provided by the localtelephone companies and other interexchange carriers which is beyond the Company s control. The service provided is an automated collect onlyservice, offered only wi thin correctional facilities for the exclusive use of inmates. The Company s service agreements are ineffect for the duration of Agreementsbetween Inmate CommunicationsCorporation and Operator Service Provider Customers. Liabili ty of Inmate Communications Corporation Company " ) Issued: The Company shall not be liable for claimor loss, expense or damage (including indirect, special or consequential damage),for any interruption, delay, error,omission, or defect in any service,facili ty or transmission provided under this tariff, if caused by any person or enti ty other than the Company, by any malfunction or any service or facility provided by any carrier, by an act of God,fire, war, civil disturbance, or act government, or by any other cause beyond the Company s direct control. The Company shall not be liable for any defacement of or damages to the premises ofOperator Service Provider Customer resul ting from the furnishing of service which is not the direct result of the Company s negligence. 4 No agent or employee of any other carrier or Company shall be deemed to be an agent or employee of the Company. The above tariff language does not consti tute determination by the Commission that a limitation of liability imposed by the Company should be upheld in a court of law. Acceptance for filing bythe Commission recognizes that it is court'responsibility to adjudicatenegligence and consequential damage claims.It is also the court'responsibility to determine the validity of the exculpatory clause.
