UPL-E-96-4 ORDER NO.  26809 On February 19, 1997, PacifiCorp dba Utah Power & Light Company, filed a Motion for an extension of time for filing its revised tariff pursuant to Order No. 26782 issued in this case on  February 6, 1997.  That Order directed PacifiCorp to file a revised line extension tariff consistent with the Commission’s findings.  According to PacifiCorp’s Motion, Company personnel have been working with the Commission Staff to acquire a full understanding of how to implement the provisions of the Order regarding refunds but do not expect to be able to meet the February 21, 1997 deadline set forth in the Order.  The Motion notes that counsel for the Commission Staff does not oppose the Company’s request for an extension. F I N D I N G S Rule 256 of the Commission’s Rules of Procedure, IDAPA 31.01.01, provides that motions seeking procedural relief will not be acted upon on fewer than 14 days notice unless the motion states the facts supporting the request to act on shorter notice and that at least one representative of all parties has received actual notice of the motion.  Subsection 3 of the rule states that the Commission may act on such a motion without waiting for responses of other parties.  We note that the only other party to this case is the Commission Staff which has indicated that it has no objection to the Motion.  We find, that under the circumstances, there is good cause for allowing PacifiCorp until March 14, 1997, to file its revised tariff implementing the terms and of Order No. 26782 and it is so ordered. O R D E R IT IS HEREBY ORDERED that the Motion of PacifiCorp for an extension of time for filing its revised tariff pursuant to Order No. 26782 until March 14, 1997, is granted.
