This Court issued an Order Conditionally Dismissing Appeal on December 4,2023, as il
appeared that Complainant-Appellant Christy Armbruster did not petition the Public Utilities
Commission for reconsideration of Order No. 35849, and was therefore, not a party aggrieved
by the order denying reconsideration, and the Notrce of Appeal filed with the Public Utilities
Commission on November 30,2023, was not filed within forty{wo (42) days from the file stamp
on Order No. 35904 entered by the Public Utilities Commission on August 25,2023, pursuant to
ldaho Appellate Rule 14(b). Appellant was allowed twenty-one (21) days from the date of the
Order to file a RESPONSE as to why the appeal should not be dismissed. A MOTION TO
ACCEPT LATE FILING OF NOTICE OF APPEAL was filed by Appellant on December 7,2023.
An OBJECTION was filed by Appellant on December 12, 2023. Therefore, after due
consideration,
lT lS ORDERED that Appellant's MOTION TO ACCEPT LATE FILING OF NOTICE OF
APPEAL is DENIED.
In the Supreme Court of the State of Idaho
lT lS FURTHER ORDERED that this appeal is DISMISSED as untimely.
