NOTICE IS HEREBY GIVEN THAT:
1. The above-named Intervenor/Appellant, Kiki Leslie A. Tidwell ("Appellant"), appeals
against the above-named Respondent, Idaho Public Utilities Commission ("Respondent"
or "Commission") and ldaho Power Company to the ldaho Supreme Court from the
Commission's final order on reconsideration Order No. 33928 entered on November 17,
2017 ("Order").

Notice ol Appeal - I
2. The following is a preliminary statement of the issues on appeal which Appellant
presently intends to assert in the appeal, subject to modification and development as
appropriate:
a. Whether the Commission abused is discretion in failing to award intervenor
funding to Appellant pursuant to ldaho Code $ 51-617A and the Commission's
Rules of Procedure, IDAPA 31.0f .01.161-165, solely on the asserted grounds that
Appellant did not timely submit an application for intervenor funding.
b. Whether the Commission's denial of Appellant's intervenor funding request based
solely on timing is arbitrary and capricious in light of previous Commission
orders awarding intervenor funding to late applicans, as occurred in Commission
Case No. IPC-E-17-03, and approving late intervenor applications, as occuned in
the present Commission proceeding.
c. Whether the August 8,2017 evidentiary hearing was "the last evidentiary hearing
in a proceeding or the deadline for submitting briefs, proposed orders, or
statements of position," as described in IDAPA 31.01.0f .164.
d. Whether the Commission adequately provided notice to all parties that intervenor
funding requests were due 14 days from the August 8,2017 evidentiary hearing.
e. Whether IDAPA 31.01,01.164 is arbiuary and capricious.
t. Appellant reserves the right to identify and raise other issues as the basis for this
appeal to the extent permitted by law.

3. Appellant has a right to appeal to the [daho Supreme Court, and the Order from which
this appeal is taken is an appealable final order under and pursuant to Idaho Appellate
Rule 1r(e) and ldaho Code $ 6l-629.

Ms. Tidwell asserts the Commission should reconsider its denial of hcr requcst for
intervenor funding for two ncasons. Firsl, she argues lrcr rcquesl "was timely as it was submitted
during rhe period that a petition for reconsideration could have been submitted" regarding the
Commission's Final Order No. 338?2. Pctition for Reconsideration at l. Second. she argues the
Commission "failed to prot'ide a fair proceeding by failing to providc adcquate information
about Section 6l-617a [thc statutc providing for intervenor fundingf to intervenots." Id.
COMMISSION DISCUSSION AND FTNDINGS
In dcnying Ms. Tid$,ell's rcquesl for intervcnor funding. we noted that it "was rcccived
almost a month after thc deadline." Ordcr No. 33906 at 2. Although Ms. Tidwell now asserts
her requert for intcrvcnor funding was timety, she stated in her intervenor funding request, "l
apologizc that this requcst is bcing submittcd late duc ltol the lack of communication lo mc that
this compensation was available to nre as an Intervenor." [,ate Requcst for lntervcnor Funding at
2. Commission Rulc 164 provides, "Unless othcrwise provided by order, an intervenor
requesting intervenor funding ntust apply no laler than fourteen (14) days afier the last
evidcntiary hcaring in a proceeding." IDAPA 3 1.01.01.164. The evidentiary trcaring took place
August 8,2017, thus the deadline for inlervenor funding reguests was August 22 pl Rulc 164.
Moreovcr, Chair Anderson gave explicit nolice to all panies at the conclusion of the technical
hearing, including Ms. Tidwell and her counsel, ahout the dcadline for intervenor funding
requests. Transcript at 686; Order No. 33$6 at 2. Consegucntly, we find no reasonable basis
for reconsideration of our prior decision finding Ms. Tidwell's request f()r intcrvcnor t'unding
unlirnely. We thus deny Ms. Tidwell's petition for rcconsideration.
