NOTICE OF STATUS OF PROCEEDINGS - 1
COMES NOW, Grouse Creek Wind, LLC and Grouse Creek Wind II, LLC (collectively
"Appellants") and hereby provides notice to the Idaho Supreme Cour ("Cour") of the status of
the Idaho Public Utilties Commssion's ("PUC") review on remand.
On November 22, 2011, ths Cour issued its Order Granting Stipulated Motion to
Suspend Appeal and Remand to the Administrative Agency ("Order"). In its Order, the Cour
provided that, "counsel for the Appellants shall notify this cour, in writing, immediately upon
the expiration of the suspension regarding the status of the proceedings in this appeaL." In
response to that directive the Appellants say as follows:
The Idaho Public Utilities Commission ("Commission") issued a Notice of Scheduling in
this matter on remand on January 2, 2012. Pursuat to that Notice of Scheduling, Idaho Power
and Staff fied intial legal briefing on Febru 6, 2012; Appellants fied their reply brief on
Februar 27, 2012; and the paries presented oral argument before the Commission on March 7,
2012. The matter is now fully submitted before the Commission and an order is expected to
issue accordingly.
It is the Appellants' understanding of the Cour's Oder that the suspension will continue
until March 15,2012, or until the Commission has completed its review on remand. Therefore,
although March 15, 2012 is upon us with no final Commission order having issued, an
additional order granting fuher suspension is not necessary.
