The Paries move the Idaho Supreme Cour to dismiss ths appeal, with each par to bear its own costs, pursuat to Idaho Appellant Rule 33, for the reasons stated below. STATEMENT IN SUPPORT OF MOTION Rocky Mountain Power, the Idaho Public Utilities ComIission Staf and other paries entered into a settlement stipulation resolving the underlying issues in IPUC Case No. PAC-E- 11-12, including the treatment of the Populus-Termnal trsmission line that is the subject of ths appea. As par of the stipulation, the Company agreed, upon receipt of a final order approving the stipulation, to withdraw the appeal curently pending before ths cour. IPUC Final Order No. 32432 approved the stipulation. Because the settlement stipulation in Case No. PAC-E-1l-12 resolves the Populus-Terminal transmission line issues, the appeal in ths case is unecessary. REQUEST FOR RELIEF The Pares move ths Cour for an Order dismissing ths appeal pursuant to i.A.R. 33, with each par to bear its own costs. d"~RESPECTFULLY submitted ths L day of Februar 2012. ¿~~ / ;)1/ J.
