COMES NOW, the Respondent on Appeal, Idaho Power Company, and pursuant to
Appellate Rules 8 and 32, responds to the Motion to File Amicus Curae Brief submitted by the
Idaho Association of Highway Distrcts, the Association of Idaho Cites, and the Idaho

Association of Counties. The mater of granting or denying the Motion for Amcus Brief is
within the Cour's discretion. However, as a matter of fudamental fairness, if the Cour grants
the Motion, Idaho Power Company requests the opportty to respond should the Amcus
Curae Brief present new issues that Idaho Power Company did not address in the underlying
case before the Idaho Public Utilities Commission.
Ths Response is supported by the Afdavit of Lisa D. Nordstrom, counel of record for
Respondent Idaho Power Company in ths appeal.
