Petitioner/Appellant, Ada County Highway District ("ACHD"), by and through its
counsel of record, Hawley Troxell Ennis & Hawley LLP, and pursuant to I.A.R. Rules 34(e) and
46, respectfully moves this Cour for a 21 day extension of time to fie Appellant's Brief so that
said Brief shall be filed no later than May 24, 2010. It is fuer requested that the deadline for
Respondents' Briefs be extended to July 9, 2010.
In accordance with I.A.R. 34( e), Appellant states the following:
1. Appellant's Brief is curently due May 3, 2010.
2. No previous extension of time has been granted.
3. No previous request for an extension of time has been denied.

4. The reasons or grounds why an extension is necessar are that counsel's schedule,
including multiple Idaho Supreme Cour deadlines, has not permitted adequate time to prepare
Appellant's Brief, as stated in the supporting Affidavits fied concurently herewith.
5. Appellant ACHD requests a 21 day extension, which wil make May 24,2010 the
date on which Appellant's Brief will be due.
6. Appellant represents that it wil fie its Appellant's Brief no later than May 24,
2010.
7. Appellant's counsel has discussed this request for extension of time with
Respondents, none of which opposes the request for extension of time.
This Motion is supported by the Affidavit of Merlyn W. Clark, fied concurrently
herewith.
