The above named Intervenor/Appellant The Building Contrctors Association of Southwester Idaho ("Appellant"), appeals against the above-named Respondent Idaho Public Utilities Commssion ("Respondent" or "Commssion") and Idaho Power Company ("Respondent" or "Company") to the Idaho Supreme Cour from the Commission's final order on reconsideration Order No. 30955 entered herein on the 30th day of November, 2009 ("Order"). NOTICE OF APPEAL - 1 2. Appllant has a right to appeal to the Idaho Supreme Cour, and the Order from which ths appeal is taken, is an appealable final order under and puruant to Idaho Appellate Rule 11(e) and Idaho Code § 61-629. 3. The following is a preliminar statement of the issues on appe which Appellant presently intends to asser in the appeal, subject to modification and development as appropriate: a. Whether the Commission's Order, elimnating a new customer's heretofore existing entitlement to a level of Company investment in distrbution facilties equal to that made by the Company to sere its existing customer in the same clas was arbitr, capricious, in excess of its authority or otherise in violation of the law. b. Whether the Commssion ered in approving amendments to the Company's line extension taff that result in unlawfully disparate rates as among new customer and as between new customer and existing customer. c. Whether the Commission erd in approving amendments to the Company's line extension tarff that result in discrminatory rates and charges as between existing and new customers. d. Wheter the Commission abused its discreton in failing to award interenor fuding to Appellant puruat to Idaho Code § 61-617 A and the Commission's Rules of Procedure, IDAPA 31.01.01.161-165, on the assered grunds that Appellant did not contrbute materally to the case, decision or decision makg process before the Commission. e.
