The only item that is settled are the Appellants evidence in Exhibits (1)(2)(3) and her
public comments.
Based on the evidence and facts of this case, the omissions and falsehoods in the
decisions not based on facts they had, and ignoring this the decisions and orders done by
both Defendants and falsifying statements I cannot agree with the agency record as
correct or settled, when it includes criminal activity and to slander the Appellant in their
tribunal while allowing Rocky Mountain Power to retain the Appellants property.
There are duplicates of orders and evidence along the exhibits of the perjured sworn
affidavit of IPUC investigator Jon Krusk while his sworn affidavit should stay in agency

record the exhibits that do not pertain the the case or the perjury are not needed, False
claims of statements by Commission staff that are known to be untrue as will be seen in
my brief This appears to be designed not only to get more money from the Appellant, but
also be fastidious and confusing and no way to treat the court or the appellant.
Both defendants appear just to v,vant to make plaintiff go away which was easily doable by
providing the correct compensation and Rocky Mountain Power's attorney walked away
from those negotiations.
