WITHDRAWAL OT MOTION
TO COMPEL
COMES NOW, the Community Action Parurership Association of Idalro (CAPAI) and,
for the reasons stated herern, withdraws its Motion to Compel responses to discovery addressed
to Rocky Mountain and filed with this Commission on July 30, 2013.
Following extensive briefing and effort by CAPAI regarding its Motion to Compel,
Rocky Mountain filed a Response to CAPAI's Motion to Compel on August 8, 2013. Despite
the many arguments contained in that Response, virtually none of which CAPAI agrees with,
Rocky Mountain conceded, nonetheless, that it would response to CAPAI discovery request No.
6(b) which was the subject of the Motion to Compel. On August 12,2013, Rocky Mountain
filed arr actual response to CAPAI's request No. 6(b).
Although it is CAPAI's position that Rocky Mountain's response indicates a lack of
comprehension of the information sought and contains statements that are erroneous or

confusing, CAPAI acc€pts the response for the purpose of its pending Motion to Compel and,
consequently, withdraws that Motion.
Though the Motionto Compel is deemed withdrawn, CAPAI waives no rights associated
with the discovery dispute in general, including whetber there might be financial consequences
to Rocky Mormtain based on its refusal to timely respond to the discovery in good faith.
