Comes now XRG-DP-7, XRG-DP-8, XRG-DP-9, XRG-DP-lO, LLCs (referred to
collectively as "XRG" or "Exergy"), and respectfully submits this withdrawal of production
requests pending resolution of sumar judgment proceedings.
As stated on the record at the oral arguent held before the Idaho Public Utilities
Commission in this matter today, XRG hereby withdraws several of its pending production

Production Request Nos. 24, 25, 26, 27, 31, 32(b), (d), (e), 33(a), 34, 35,40,45, and 47.
The remaining requests, or subpars of requests, subject to Rocky Mountain Power's
Motion for Protective Order (Request Nos. 24-52), but not listed above, are hereby withdrawn
pending resolution of the sumary judgment proceedings without waiving the right to reassert
those requests at a later time.
