PAC-E-6S-6S INERVENOR FUING APPLICATION FOR INRVENOR FUING OF TH IDAHO IRGATION PUMERS ASSOCIATION, INC. COMES NOW the Idaho Irrgation Pumpers Association, Inc. (ItIIPA"), by and though counsel of record, Eric L. Olsen, and hereby respectfully makes application to the Idaho Public Utilities Commission ("Commission") for intervenor fuding, pursuant to Idaho Code § 61 -6 1 7 A and IDAPA 31.01.01.161 through .165, regarding the expenses and costs associated with IIPA's paricipation in the above referenced matter, as follows: (A) A sumar of the expenses that the IIPA requests to be recovered is broken down into legal fees, consultant fees and other costs and expenses and is set fort in Exhibit "A" attached hereto and incorporated by reference. Itemized statements are also included as Attachments 1 and 2 to Exhibit "A" in support of said sumar and are incorporated by reference. APPLICATION FOR INTERVENOR FUING OF IDAHO IRGATION PUMERS ASSOCIATION, INC.-l i i l t (B) On October 23, 2008, Rocky Mountain Power ("RMP" or "the Company") fied an application (the "Application") seeking approval of an energy cost adjustment mechanism (tlECAMtI). RMP's proposed ECAM is designed to defer the difference between base net power costs set durng a general rate case and collected from customers in their retail rates and actual net power costs incurred by the Company to serve retail customers. The calculation of the deferral would be on a monthly basis by comparng the monthly base net power cost ("NPC") rate in dollars per megawatt-hour to the actual NPC rate also in dollars per megawatt-hour. The resulting monthly NPC differential rate would be applied to actual Idaho retail load to calculate the NPC differential for deferraL. The net power costs of$982 milion, as stipulated in Rocky Mountain Power's general rate Case No. PAC-E-08-07, Order No. 30783, will be the base NPC for the ECAM until re-set in the next general rate case. With a view toward resolving the issues raised in the Application, RMP, Staff for the Idaho Public Utilities Commission (tlStaff'), Monsanto Company ("Monsanto"), and the LIP A (collectively referred to as the "Paries") met and held conference calls, pursuant to IDAPA 31.01.01.271 and .272, to engage in settlement discussions. Based upon the settlement discussions among the Paries, a compromise agreement was reached which the Paries believe is in the public's interest. The terms of the agreement are set forth more fully in the stipulation ("Stipulation") fied with the Commission on June 23, 2009. As a signatory and as fuer outlined in the IIPA's testimony fied in support thereof, the LIP A urges the Commission to adopt the terms of the Stipulation. The key provisions in the Stipulation include the following: APPLICATION FOR INTERVENOR FUING OF IDAHO IRGATION PUMERS ASSOCIATION, INC. - i , ,, 1 i. In the Stipulation the Paries agreed that the design, format and accounts of the ECAM would be as set fort in the Company's Application in and as more fuly detailed by the Company in its supporting testimony. 2. The Paries agreed that the ECAM was to be effective July i, 2009, provided that the Commission had issued an order approving the ECAM consistent with the terms in the Stipulation. 3. The Paries agreed that the ECAM would include a syetrcal sharng band wherein when there is a difference between actual NPC and base NPC, customers pay (if there is an increase in NPC) or receive (if there is a decrease in NPC) 90 percent of the difference, and the Company is responsible for the remaining i 0 percent. 4. The Paries agreed that the anual deferral period to be used in the ECAM would be December i to November 30, and that anually, on Februar i, the Company wil fie an application with the Commission to adjust the surcharge or surcredit ("ECAM Rate") effective April i each year, refuding or collecting the ECAM deferred balance from the prior deferral period. 5. The Parties agreed that a symetrcal load growth adjustment rate (LGAR) of$ i 7.48 per MWH will be applied to the incremental load from the base load as set forth in Case No. PAC-E-08-07, and that the LGAR and base load will be updated each time base net power costs are updated in a general rate case. 6. The Paries recognized that the Company had made signficant investments in renewable generation projects that are not yet being recovered in Idaho rates and that these projects provide significant benefits to customers through the ECAM and that therefore, from the effective date of the ECAM to the effective date of rates in the next general rate case, the Paries agreed that the ECAM would include a renewable generation offset adjustment. The adjustment recognzes that APPLICATION FOR INERVENOR FUING OF IDAHO IRGATION PUMERS ASSOCIATION, INC. - 3 , . actual power costs have or will been reduced by power generated from these renewable generation projects, but that the costs of these projects are not yet being recovered in Idaho base rates. The adjustment wil be based on $55.00 per MWh multiplied by the actual MWh output generated by the renewable resources that were not included in rate base in RMP's last rate case. 7. In the event the Company intends to seek an increase to the ECAM Rate exceeding seven (7) percent, the Company agreed to meet with the Staff and interested paries to discuss the underlying drivers of such a change at least 30 days prior to filing an application with the Commission for approval of the change to the ECAM Rate. 8. The Company agreed to work with the Paries to develop rates that reflect line losses and distinguishes transmission, primar and secondar voltage delivery service in the implementation of the ECAM Rate. A technical conference wil be convened by August 15,2009 to begin discussions on a methodology aId will use line loss information from the 2008 general rate case (Docket P A C- E-08-07) as a staring point for the discussions. In the event an agreement on rate design for the ECAM Rate is not reached by April 1, 2010, the ECAM Rate will be applied to all schedules and customers on a flat KWh usage basis until an agreement is reached or a method is ordered by the Commission. 9. In exchange for implementing the ECAM with the adjustment for renewable energy generation projects, RMP agreed not to fie a general rate case prior to May 2, 2010. Each Par agreed that the Stipulation represented a fair, just and reasonable compromise and was in the public's best interest. Pursuant to IDAPA 31.01.01.274, the Paries signed and submitted it to the Commission for approval on June 23,2009. APPLICATION FOR INERVENOR FUING OF IDAHO IRGATION PUMERS ASSOCIATION, INC. - 4 . , Although this case was ultimately settled, lIP A had to prepare as though it was a fully contested case before the Commission. lIP A's legal counsel, Eric L. Olsen, and consultant, Anthony J. Yanel, P .E., have all paricipated directly or indirectly in varous meetings, conference calls, and drafting supporting documentation that have resulted in these important changes. Overall, lIP A believes that the Stipulation should be adopted by the Commission and that LIP A should be reimbursed for its reasonable expenses associated with its intervention. (C) The expenses and costs incurred by IIPA set forth in Exhibit A and accompanying attachments are reasonable in amount and were necessarily incured to paricipate in this case. The expenses and costs were incured in corresponding and collaborating with all the Paries, and in gathering information, drafing and reviewing documentation and testimony, and negotiating the changes. (D) The costs described in Paragraph (A) above constitute a financial hardship for lIP A. LIP A curently has approximately $55,000.00 in the ban with outstanding accounts payable from paricipation in this case and other concurrent cases totaling approximately $45,000.00. LIP A is an Idaho nonprofit corporation that was organized in 1968 to represent agrcultural interests in electric utility rate matters affecting farers in southern and central Idaho. LIP A relies solely upon dues and contributions voluntarily paid by members, together with intervenor fuding, to support activities. Each year mailings are sent to approximately 7,500 Idaho Irrgators (approximately two-thirds in the Idaho Power Company service area and one-third in the RMP service area), soliciting anual dues. LIP A recommends that members make voluntar contrbutions based on acres irrigated or horsepower per pump. Member contributions have been falling APPLICATION FOR INRVENOR FUING OF IDAHO IRGATION PUMERS ASSOCIATION, INC. - S . , presumably due to the curent depressed economy, increased operating costs and threats relating to water right protection issues. From member contributions LIP A must pay all expenses, which generally include mailing expenses, meeting expenses and shared office space in Boise, Idaho, in addition to the expenses relating to paricipation in rate case's. The Executive Director, Lynn Tominaga, is the only par-time paid employee, receiving a retainer plus expenses for offce space, office equipment, and secretaral services. Officers and directors are elected anually and serve without compensation. It has been and continues to be a financial hardship for LIP A to fully paricipate in this case. As a result of financial constraints, paricipation in this case has been selective and, primarly, on a limited basis. (E) Although the Paries have reached a stipulation in this case, LIP A provided a unque perspective on a number of issues that impact other customer classes. With respect to the "stay out" provision and the inclusion of wind generation surogate, the LIP A recognized that for the "stay out" agreement to be meaningful, RMPhad to forego something less than it would have possibly gotten if it had gone forward with its intended 2009 rate case. Durng the negotiations, the LIP A rejected RMP's initial surogate amount because it would have amounted to an increase approximately equivalent to the rate increase implemented in RMP's 2008 rate case. As a compromise, the Paries agreed to the $55 per MWh price that is provided in Paragraph 8 in the Stipulation. (See Yanel Dir., at p. 7, lines 17-22 to p. 9, line 13.) lIP A also focused on the issue of line losses and the distinction of taking service at the primar, transmission and secondar level in determining how to spread the ECAM adjustments in the futue. RMP proposed to spread the adjustment on an equal cents per kWh basis. However, it APPLICATION FOR INERVEOR FUING OF IDAHO IRGATION PUMERS ASSOCIATION, INC. - 6 . . is understood that a kWh for sale at the secondar distribution level is not the equivalent to a kWh as the primar distrbution or transmission level due to losses. Thus, the Paries agreed to convene a technical conference by August 15,2009 to begin discussions on a methodology and wil use line loss information from the 2008 general rate case (Docket PAC-E-08-07) as a staring point for the discussions. In the event an agreement on rate design for the ECAM Rate is not reached by April 1,2010, the ECAM Rate will be applied to all schedules and customers on a flat KWh usage basis until an agreement is reached or a method is ordered by the Commission. Based on the above, the LIP A believes that its recommendations relating to the adoption of an ECAM differed materially from the positions taken by the Staff and should materially assist the Commission in makng its decision on this matter. (F) By taing the position that the "stay out" provision needed to be meaningful and compromising on the $55 per MWh surogate, the IIPA efforts will benefit all customer classes by likely receiving a lower increase through the first year of the application of the ECAM than ifRMP had fied its 2009 general rate case to put the new wind generation in rate base. Also, by studying the line loss issues, the ECAM wil hopefully be spread on cost of service principals to send the appropriate price signals to the customer classes. (6) LIP A represents the irrigation class of customers under Schedule 24. Based on the foregoing, it is respectfully submitted that the LIP A is a qualifying intervenor and should be entitled to an award of costs of intervention in the maximum amount allowable pursuant to Idaho Code § 61-617A and IDAPA 31.01.01.161 through .165.
